eBay seller sent item to wrong address!

I bought my mum a item off ebay right guys for christmas..and the buyer said oh you willl have it tommorrow. Waited in all day and it didnt arrive so i emailed the seller asking for the tracking number. When i put it into royal mail's site it had a completely different address in ireland.
I emailed the seller and asked him if he'll re-ship the item to me. His message said this

'Hi there,

Thanks for contacting Photo Direct on ebay. Unfortunately this was a warehouse error, we apologise but you will not be refunded.
Any attempt to file a dispute and we will involve the UK Police'

WTF? Really ? I was shocked by the message, it's as if the seller made a big cock up and doesn't wanna hold responsibiltiy..if I open a dispute would i win? or would ebay/paypal say its my fault?

they_screwed_me_too 11-27-2012 10:13 AM

if hes sent to an addresss different to the one in eb/pp then you would win the case

if its as simple as that

tell him to call the feds

youve nothing to hide right

LOL. He admits that he/his company was in the wrong but doesn't want to resolve it? I'd report him to eBay for that message.

He sent the item to Ireland? How could he mixup your address with one in a completely different country?

moneyhustler88 11-27-2012 10:29 AM

Well i don't want to disclose my address but it's not Ireland. I was really nice too them and i said, i'm happy for them to keep the funds and i won't open a dispute and they can just send me the right item back. And thats what the response was I got.
I just got off the phone with ebay customer services who told me that I need to open a dispute on paypal..i've done that..and i can't escalate it for 2 days which is annonying because looks like ill be waiting years to get a refund as they clearly don't want to send me another item.
So I've replied to the seller stating this:

Hi,
Thanks for the email. I'm really sorry if we have got our wires crossed here, I ordered the item using my credit card and Paypal verified the address and I'm a verified ebay user with over 200 feedback+ 100%.
I can understand a mistake was made, and hey we're all only human. I've already explained in my last email I accept mistakes happen, but my address is in the north of england, and you sent my item to Ireland? The house number, street etc has no nearness in name or sound?
This is meant to be a christmas present for my mother and this whole matter is a bit unfair.
All I am asking is you send me the correct item to the correct address?
Also as for reporting me to the police, I've legally done nothing wrong therefore feel free to here is my details and address for you to do so:
XXXXX

Just file a complaint and get you money back, they are obviously trying to run some sort of scam.

moneyhustler88 11-27-2012 10:36 AM

Do you think Johnson? Well the user is a powerseller, although I noticed 7 other negative feedbacks in the last 6 months for similiar kind of thing - wrong address, non reciept, damaged goods..

Johnson1 11-27-2012 10:45 AM

If someone contacts you saying do not file a complaint or I will go to the police when they sent it to the wrong address. Then yes, I think they are scamming.

Hmm yeah maybe!

I can't help but feel there's a piece of the puzzle missing. Anyone selling on ebay would know that's NOT how you handle a situation.

You don't:

1. screw up
2. admit it
3. threaten

So you paid with a full verified paypal and they shipped to wrong address? If it's that simple, just file a dispute... you will win.

moneyhustler88 11-27-2012 06:59 PM

Yes I did, opened a dispute and said i escalate it to a claim in 24 hours. The funny thing is when i rang paypal the woman said 'i know whats happened' and 'don't worry'..so maybe a pp glitch? really dnt know

BigCJ 11-27-2012 07:45 PM

I wonder if they will get banned for that? Interesting case...

I dont think they will get banned for 1 mis-shipped item or dispute. Make enough mistakes, then yea say good bye to your ebay account.

GreenBean 11-27-2012 11:27 PM

You seriously should not use ebay or paypal.

Every thread is some idiotic error & you are always the common factor.

We have re-run after re-run of Hustler & selling rubbish.

Do not insult me by claiming a 2nd seller stuffed sending out an item.

Big gaps in this story.. BIG

This really does sound silly.

I'll do a name change to The Boy Who Cried Wolf. Just let me know
