Need advice! Important!
 

Hi all,

I bought a virtual online item for £3,195 and paid though ebay and Paypal. (with the intention of re-selling) The seller said he would provide the details in 72 hours.

It has now been 5 days and I don't have anything yet. I obviously need my money back and want to open a case. How do I go about it so that I will definatly 100% win? This is a serious amount of money (infact it was all my savings that I used)


The only reason I ask is because I bought a gift card a while back and the code was emailed to me only, without a physical item. I opened a dispute when the card didn't work and it was decided in the sellers favour who got their money back.:doh:

I cannot afford for this to happen. Please any advice will be very helpful.

hard to say what to do, as it depends what item it is and how it was bought,
you may have to say it was something slightly different. like you say if you say it is a virtual card, they may not be covered. you need something with shipping ideally.

did you pay with a credit card via paypal?

Paypal dislikes sale of virtual items - if you open a claim you must declare a physical item expected. Hate to be a bearer of bad news but 5 days...your seller may have gotten the money out so you might have problems.

That being said, oompa`s q is important to answer: if you paid via credit card, you may well be protected by your cc provider.

Were there funds ( as in a balance) in paypal or did you have a credit card as a funding source?

Have you tried to contact the seller?

Got their phone number or such?

I thought virtual items were automatically decided in the buyers favour due to no proof of delivery. It was funded via debit card linked to PP

No Paypal balance, I paid in full on debit card. I contacted the seller but he is blaming me because PP closed his account while he was trying to withdraw

Seller blaming you? Sounds like he is a rookie with pp himself then...sounds like you have better chance at getting the funds back if he has not been successful with his withdrawal AND his account is closed.

PP will tend to rule in buyer`s favour with the funds still in their system...

Yeah, its pigeon English but from what I can read they have closed/frozen/disabled/limited his account for some reason. Fingers crossed.

He rang them and they are getting back to him in 24-48 hours

so paypal closed the seller down, well selling virtual goods puts him at risk of that or maybe he was already in dispute with other people and you were caught up in the closure....

the risk is that the seller will just walk away from the account, if there is a balance in the paypal ( you said he was trying to withdraw) then paypal may be generous and refund you, depends on how many other cases there are.

certain virtual goods are specifically prohibited under T&C of paypal, others just do not
fall under buyer protection unless at least a paper copy or disc etc gets delivered....if they allow in your favour it will be at their discretion and not because they have to.

as for debit card, you could try talking to your bank about it.

A debit card? Might be tough then. Which bank is this with? Get onto them too.

Contact paypal/ebay. Make waves and do not sit back 'waiting'.

**** guys... 14,700.00 PLN is about £3,100 ... I am by no means rich, this is a serious amount of money to me (all my savings infact). I was investing in order to secure a future for my (our) first newborn baby daughter.

Try and contact your bank and tell them that you have major issues. Maybe they can get the money back just have any emails and other documentation of your case to give your bank. Good luck

I'd also call ebay and Paypal and keep calling and talking to different reps hopefully you get someone that helps you

Good point to contact your bank now - sadly not much else to do.

Relax. While Paypal is terrible and illogical in its decisions in regards to buyer protection, banks are not. As long as your debit card has a Visa/Mastercard/etc logo, you can initiate a chargeback. You will win the dispute and Paypal will have to return the money to your bank.

However, you still ( luckily) have options under UK consumer law.
