Received this email:

"We are hereby notifying you that, after a recent review of your account
activity, it has been determined that you are in violation of PayPal's
Acceptable Use Policy regarding your sales / offers on eBay.com, user ID:
********.

Therefore, your account has been permanently limited.

Per the User Agreement, when PayPal permanently limits an account due to an
Acceptable Use Policy violation, we may hold your funds up to 180 days. In
addition, you will be liable to PayPal for the amount of PayPal's damages
for each violation of the Acceptable Use Policy.

relevant information pertaining to the User Agreement, please refer to the

You will need to remove all references to PayPal from your website/s and/or

reserves the right to limit an account for any violation of the User
Agreement, including the Acceptable Use Policy.

Under the Acceptable Use Policy, PayPal may not be used to send or receive
payments for items that infringe or violate any copyright, trademark, right
of publicity or privacy, or any other proprietary right under the laws of
any jurisdiction. This includes transactions for counterfeit items or
unauthorized replicas or copies of items.

I recently refunded two buys because they "changed their minds" about the product and they opened claims.


I was selling High end Designer bags, not ⊗⊗⊗⊗ at all.

Now PayPal is saying that I will be liable for damages? What does this mean...

Any help?

High end designer bags are considered VERY high risk to sell - l...this is the cause of your problems.

Liable for damages means if any more problems happen - which is rare since you refunded so I would not worry about this.

OP, do you have proof that they arent replicas?

It means paypal are coveirng themselves if any more claims come in from other buyers. They state in their T&S they have the right to fine users if they see fit.

Make sure you refund everyone and keep your receipts as proof of purchase & legitimacy.
Be aware that ebay may also contact other buyers and make issues for you.
Are there other sales, even completed ones?

It is VERY difficult to sell brand name items on eBay, especially those that are heavily counterfeited. Designer handbags are near the top of that category. Even if your merchandise is totally legitimate, you can easily have problems as you found out the hard way.

If you have proof that your items are authentic, you might want to contact PayPal and see if providing them with the proof might get you the account back. It is a LONGSHOT, but it could happen.

GreenBean is 100% correct. eBay/PayPal may send your other customers an email telling them your account was suspended for security reasons and invite them to file claims to get their money back. And if they believe the items are counterfeit, they will not require the buyers to send the items back to you.

This is a fairly severe action for PayPal to take. Normally, the account is temporarily suspended and information is requested, like proof of identity and invoices showing a legitimate source of goods. The fact that they permanently suspended you suggests to me they have a VERY STRONG belief the items in question are counterfeit. It could be something they saw in your listing, or perhaps a customer complaint. Whatever it was, they did not like what they saw.

I am NOT judging you and I am NOT saying your items are counterfeit. You say they are legitimate and I am taking you at your word. I'm just trying to let you know, without sugarcoating it, how PayPal is seeing it.

Normally, I advise people NOT to contact PayPal unless there is no other option. If you have the proof they are legitimate, it is my opinion that contacting them is your best bet. Even if you don't get the account back, you might be able to minimize any losses. But with this type of thing, there are no guarantees. I wish I had better news for you.

It is unfair, of course, but the counterfeiters have ruined it for everyone.
