Copyright strike - How long do they last?
 

Hi

I am trying to run a legitimate business on ebay selling diagnostic car equipment, unfortunately i am finding its a bit of a cut throat area with people throwing vero infractions at the slightest whim!

I am a genuine business but I have managed to knock up 2 copyright warnings (two separate products) in 4months, i am worried any more and i am on the verge of a 7 day ban followed by 30 day then total account limitation.

I want to nip this in the bud early as i can, how long do the copyright marks stay before they get made as "spent"

I have the figure of 12months in my head but cant be sure

12 months is the time frame, usually 3 strikes before trouble. If you have a legit counterclaim, dispute it.

I have found in the UK there is absolutly no recourse to argue a vero mark, ebay have told me that once the copyright holder has made a complaint, the only way to reverse it is through the copyright holder which is total bull **** as they are literally the judge and jury at the same time, its so unfair its ridiculous.

Have you reached out to the actual holder of the mark? If you have a legit claim/non-infringing right to use it, they may help you.

I have been talking to one of them and they have agreed they were incorrect but they wont make the bloody effort to help me remove the mark, i tried speaking to ebay and they said unless they contact them directly there is nothing they can do.

So anoying!!

and then the other one isnt replying to any emails what so ever, its a complete joke.

Depends on the value of the business whether or not it's worthwhile to fight it.

You could have a lawyer send a threatening letter and see if you can encourage them to remove it.

I had a vero partner actually email eBay to admit their mistake.
Too late though.
Ebay suspension not lifted.
