Scam victim at ebay/paypal - Help plz
 

I bought a digitally delivered item on ebay, The item was a bundle of 5 and I needed only 4 and negociated with seller, who said buy bundle of 5 then he will partially refund me for the one I dont want, so bought and he has refunded for the one I did not want.

Here is the real issue, he had promised on ebay messages to deliver the 4 item via ebay message within 48 hours but its been week now, nothing received, he is not even replying messages. Went to purchase history and tried opening a case ebay says payment is not received, so it seems seller marked the transaction as payment not received or something, so I am unable to open a case or anything, Contacted ebay via online chat and they say they cant do anything as digitally delivered item and is not covered under ebay warranty,
Asked me to contact police action fraud.

What do I do please?
Does paypal cover digtally delivered item in terms of warranty?

Any help appreciated, I spent just under 100 quid.

DO him over if he tried to screw you, open item not recieved for all of them. He wont win.

Yes, I did, In paypal it is paid out then partially been refunded, While chatting with ebay agent and asked the same question, he said it is because payment minght be on hold in seller account.

You mean the seller cannot refund if the money is on hold? I've done it before, just look up the transaction on PayPal and refund from there.
