Listings removed Buyers already paid
 
Hi, I had a buy it now listing and had already sold over 20 items from it when ebay removed my listing claiming it was trademark infringment because of another seller selling the same item reporting me multiple times.

The buyers who had bought my item had paid and i have posted them 2 to 3 days ago ,

What message will my buyers have recieved from ebay about this ?
as i feel this is just going to cause a lot of chargebacks thanks to ebays unfairness and letting non brand owners report items

you could message and explain the situation

mite make buyers a little more understanding,they could assume you are a scammer or something

eb will tell them not to do the transaction because listing is removed.

pp might get on your account with disputes initiated by them - hopefully not but be prepared with tracking info.

professional buyers might seize this opportunity to launch claims.

What item/category you dealing with?

It is vero ,but genuine vero the items where all sent before my so called policy breech

I even phoned ebay for over a hour today and they had no reason to take my listings down it was just another person reprting me

It happened about 3 weeks ago aswell i phoned ebay and they said to put more pictures in my listing and i would be fine which i did

I have reciepts which i said i would send them i even offered to send them one of the items to check for them self but they didnt want to know

I would understand if the brand owner wanted the listings removed but it was just a normal ebay member

Its just if ebay has messaged my buyers saying the item is removed because of trademark there straight away going to think my items are phakes

E-mail all your buyers right away and explain that items have been sent, not phake, etc. COMMUNICATION IS KEY.

How do you know it was another seller who reported you, did e/b tell you this or are you just assuming that to be the case?

When it happend around 3 weeks ago ,I asked if it was a nother seller selling the same items who reported me and they said they couldnt tell me what they where selling buy yes it was another member

I know it was another seller this time aswell as they are hundreds of the item listed which are 100% phakes(as its immpossible to have that ammount) and they are selling 150+ a month and they would have all been removed aswell if it was the brand owners

Not always the case.

Happens all the time on e/b, somebody gets hit with a rights owners takedown whist others manage to avoid it. It just depends on who's listings they find at any given time.

If you are going to wreck somebody's business then you need to be 100% sure it was them. Being pretty sure is a bit too of the mark imo

I would suggest that you don't try to do what they did to you, who ever did this carma will handle it for you! Just adjust and do things differently, and I would fax them proof of you claims so if it does happen again you are covered. E-bay is being sued right now for these kind of issues.

I had a seller that I purchased from send me an e-mail today because his listings were being taken down. It rediculous that they will do this to other sellers, and don't ask for proof to back their claims up! Sellers do you have to get put out of business before you find a new home?:pout:

My experience has been that ebay will tell you if the Rights Owner has requested that the item be removed. Moreover, they will provide an email for you to contact the rights owner. If the stuff you are selling are 100% legitimate/genuine products, I would recommend that you contact the rights owner and explain your situation and request that they contact ebay and reinstate the listing. Tell them that you are willing to mail then a sample and the copy of the invoice of where you bought the stuff from.

Its nike so iam 100% it wasnt them who got me taken down as there people on ebay now whith huge ammounts of phakes that would of been taken down months ago.

I check other sellers everyday to how many they have sold compared to me , none of them have ever been taken down .

Im not going to bother reporting who i thought it was as iam not that sort of person ,i think its pathetic that sellers report other sellers and even worse that ebay even listens to them.

My accounts policy has gone from high to very low within a week and i cannot sell for 30 days even though i have 5 out 5 dsrs and 100% feedback from well over 100+ sales ebays a joke

All they told me to do is put proof in my listing that the items are genuine which is impossible,They dont care that i have invoices for my items all they said was i should report other sellers if i have a problem with being reported

My listing was taken down for not having enough pictures even though i had 12 pictures every other person who sells the same thing has 1 or 2 max,

Which i told ebay on the phone and they said they werent clear enough even though they couldnt be any clearer and are taken with a high quality camera.The rep even said she couldnt see the item properly in the picture when its the clearest quality a picture can be,The reps must get trained to say that nothing ebay does is wrong

I was even reported for keyword spamming when i dont at all

They wont admit they where wrong for removing my listing ,I just dont get how some one selling phake ****e can get my listing for genuine products taken down its crazy

The nike item i had where 1000% genuine official nike products they where bought from one of littlewoods clearance sites

It seems to me that you are selling a item that someone wants all the rights

to and it also seems they know what they are doing when it comes to

reporting people. i would look at your past sales because id say they have

bought from you. I would also say they are definatly stealth and buying from

you on multible accounts as EB would not remove the listings on 1 complaint.

My advice would be create 2 accounts and list the same item. Once you

have sold a few of the item cross reference with the accounts that the

listings have been removed and if the same buyer is buying on the same

accounts then BINGO you have the Tw$t that is reporting you then im afraid

revenge is sweet :twisted:

^^^ An ebay member doesnt have to BUY an item in order to report you.
Anyone can report you so this method may not necessarily work.
