PayPal Seller Help
 

I bought an item on PayPal which was meant to be a watch. I got chatting to someone on a forum who was selling the designer watch and he said I could pay via paypal so I did.

The seller never sent the item so I opened a dispute after being forced to despite numerous emails. The items were sent as goods and with my address specified on paypal. Now the seller's claiming that I'm lieing and it was for services even though an address is specified on the order.

I know this guy is just trying to scam me and it's aload of crap so he can keep my money and not send anything. So they asked him for the normal verification- proof of postage. He's attached a screenshot of a email where I said 'To pay via paypal is fine'. This doesn't really verify anything because the context of that message was a response to numerous messages i sent via the forums.

I've spoke to the forum and they've now banned this member for spamming. So I've reported the matter to action police who've sent me a letter and i've uploaded that as supporting documentation to the case.

Although only 1 of 2 of those documents seem to have got attached... So now today is the day that paypal is meant to make their decision. Do you think I should call paypal..or I should just let them deal with it?

Let them deal with it, it is very very likely that it will be found in your favour as seller has not provided postage tracking details.

thanks north. I hope so as I do not appreciate being robbed or bent over by him or paypal. Well he's attached this screenshot as a proof of postage as he says its a 'email from client proof of agreement to service'..when its not.

Why would he accept a payment which is delievery of an item to an address, when he's offering a service. It seems to me he just wants to manipulate the system and scam me.

I'm so angry. As of yet I've heard nothing. Maybe at midnight or tommorrow I may hear something hopefully.

I'm also annonyed as i've faxed them, emailed too..the police letter which states that the police have seen a email from the seller that this was a item sale for a designer watch. But for some reason it hasn't attached to the case yet. Annonying.com

Well im unsure what to do now..its the 14th today and it said they'll decide by the 13th..and ive heard nothing :s

Paypal can sometimes take up to a 21 days to complete there investigations.

If there seller has not provided proof that he posted it and you signed for it,
I think you would most likely get your money back and his account hopefully suspended.

A specified date is rarely kept to by paypal.

Try to hold on for a bit longer.

Make some enquiries if anyone else was scammed on the same forum...be discreet, of course.

Hi here's an update guys.

Logged onto my paypal account and can see that paypal have now also adding as a supporting document my crime reference number from action police and the action police letter now. Action Police's letter stated that the user (seller) has been scamming people and they raided his house and found emails on his PC relating to over 100 victims. The Police said for data confidentality reasons they can't disclose who or what but the cases were very similiar to mine and they did find an email saying that the gentlemen was selling me a designer watch, therefore paypal should refund me as they have contacted all local couriers and no one ever delievered an item.
The Seller has attached an email screenshot as his proof of delievery though as stated before an email from the forums hes saying was proof of delievery a message from myself saying 'yes paypals fine'- i really don't think this is 'valid proof of postage' to be fair?!.
but in my supporting documents in the case it shows that letter+ the crime ref card i scanned in.
Hopefully i'll just wait and i should get a response from PayPal i'm guessing?

PP can be a bit slow sometimes, give them a few more days and then make enquires.

No worries, PP will find in your favour even if they take a few more days to do it.

yes paypal have a 'reputation' to uphold, so when the police is involved for fraud, it is highly likely you will get your money back otherwise paypal can be seen to be assisting the buyer in committing fraud.

Rest assured we have none of that fraud stuff happening on this forum.

When they are ready.... they refer to a specialised department.

Do not expect them to rush just to suit you.

I totally understand GreenBean, a valid point to consider. Well they rejected my claim so far on a basis that it was for a intangible item. I've rang them and appealed this and they've now requested additional information from me.I re-submitted all the documents and oddly they seem to have now changed the review date from 18th May to 12th June..the case now says this when I view it in paypal:

Status
A claims specialist is reviewing your case.

What happens next

We'll contact you with any developments or if we require additional information from you by 12 Jun 2013.

Your better response was to send an email outlining everything you said here, including the police report info.
Tell them you expect a refund promptly as Police have proved seller committed fraud

Hi well I got a email at 5am today saying the case was closed in the sellers favous as it was an intangibile item.

How paypal worked that out when it had a physical address for shipping don't ask me..so the only way I could appeal was by opening a not as described case but obviously..that isn'tthe issue here.
So I just rang and explained the situation. Got told by a PayPal agent that he would re=file the case and to keep an eye on my email.

About 4 hours later it said I needed to respond within 3 days and provide additional info. I did that added everything on and it said expect a response by May 18th. Then within about 4 minutes changed to what I put above and Jun 12th

Should I just email them from now on then?

I would have though it would have been pretty clean cut once fraud had been proven .



I would love to know how they managed to get hold of his real address to raid him though...lol

So did i but because the sellers claiming it was intangible they just won't seem to get this out their head..now ive been told ill be refunded partially but not fully :s via email

Best to stick with e-mails. Now that you have a set date June 12th - all you can do is sit and wait...dont keep pushing PP.

Quick recap:

you submitted your evidence backed with a police report that the seller was committing fraud.

paypal are dragging this out and declining resolution for you. They are leaning towards the seller's version only.

I looked at the cases and they have clearly indicated in the original transaction a postage address, so how can they not be for items eligible?
Secondly i attached the Police Report.
If I file a chargeback with my credit card company..as this seems the only option now..will my paypal be limited ?

I don't agree that I violated acceptable use policy for this so rang paypal today. All the guy said was that i said agree' and the original screenshot. I argued assertively that how can the police be wrong/ And all paypal said is theyre not interetsed or willing to disucss it anymore. I told them this isn't acceptable and I'll file a chargeback. They said if you do we'll limit your account. Then literally a minute after coming off the phone I recieved a 'elevated account reversal' email. It says that i have had a high number of account reversals and they want to know if everythings okay. If it continues they will look into my account and may suspend it! I did a forum search here couldn't seem to find anything about this kind of rubbish email. But a google search revealed someone else had it on only 1 item they bought in a year but were a seller too with a few chargebacks. (5 in total) and oddly they got their account back..the thing is this is a stealth to me..and it doesnt matter i have 60 others..but I have a big transaction pending from the account for £1500 for my supplies as i sell on ebay. I dont want to get limited till after that transaction. I checked right now though a few hours after that emai and nothing.
The whole matters ridiculous...a clever seller has tricked me and manipulated the protection scheme. Now i'm being threatened by cs reps with these kind of emails.
