MC019 eBay Listing Removed: Copyright Breach
 
My whole ebay listing had been pulled off due to the following reasons:

Thank you for your recent listing on eBay. The rights owner or an agent authorized to act on behalf of the rights owner, ***, notified eBay that this listing breaches intellectual property rights. When eBay receives a report of this type of breach, we remove the listing to comply with the law.

I had tried to search my item on ebay again, my competitors are selling them freely still, there are TONS of listing out there NOT ban. From my experience in this field for 5 years, I could tell I am the only victim been banned.

May I ask the reasons behind it please? why my competitors are free to sell but I got MC019. If I cool this off for 3-6 months, will that agents go away from my account?

From experience if you receive this again you won't be able to list any new products for 7 days.

3 strikes and your suspended.

Is the item legit? If so have you tried contacting the rights owner?

Be very careful.

Thanks for your response.

I had already taken down ALL related listings. my account seems fine. with very low policy compliance. but I am still able to list stuff.

I had emailed the email given twice still no reply. I just wonder why ALL my competitors are freely to sell.

Account will be marked now. The strikes may no longer count on your seller's dashboard. But if you do something wrong in months to come you could have trouble

The other sellers may have approval to sell the item. They may have strikes as well

Have you made contact with the rights holder. That is who you need to contact

Just because others sell things does not unfortunately mean that it is safe for you to do.

You cannot sell these items again, and you have to be careful with the account for a number of months now

Yes I had contacted them twice, no reply still. maybe it is UK Midnight. Do they reply on emails like me?

For some seasons I knew other sellers shared the same supplier with me. So I do not get it why I am the only victim.

I am not going to list anything for now. I will wait 3 -6 months is it wise to do so?

As GB said, for all you know they may well have had lots of listings taken down as well.

I know that you want an explanation as to why others are able to sell this item and you are not. However, nobody on the forum can answer that and eBay will not give you that information. For whatever reasons, the copyright owner asked eBay to take down your listings. Why others can still sell is really not the issue - and some good guesses as to why were already made in the above posts.

Now, there are two things you can do:
  • Stop selling the item on that account
  • Email the rights owner and ask for permission to sell the item. Keep in mind that the rights owner does NOT have to give that permission. Some rights owners will and some will not.
I would only use the second option if your items are authentic. The rights owner will probably want some sort of proof that the item is authentic. That could be a sample of the product, an invoice from your supplier, or other things along those lines. If you get into all that with them, and it turns out your merchandise is counterfeit, you could be in for a world of trouble.

I would also not assume that everyone is allowed to sell the item but you. Some rights owners have dozens of listings removed every single day, so it is just a matter of time before they get to the other sellers. And some of the other sellers may have their permission to sell.

One thing is certain, if you keep re-listing this item, the account will be history.

Account is flagged. Dont relist the item without getting clearance. Keep pressing for the rights owner response if you can prove the authenticity.

Not unless you have entirely resolved the issues of authenticity.
