Okay, just had this happen to me, pretty shocked to be honest.

I bought something on eBay around a month ago, it arrived and it was phake. I messaged the seller and he was extremely rude.

The seller admitted he sent phake goods to me in messages and said he won't refund me. I opened a "request" and eBay requested I send it back to him, even though it's phake and he admitted it, which I provided evidence of in the request.

I sent the item back to him 1st class recorded delivery and added tracking to the request. The tracking still hasn't updated at all since I posted it and the seller hasn't responded to me asking him if he received it.

I messaged eBay about it and said that the seller admitted he sent me phake goods, has been extremely rude and I had sent it back to him and he will not reply.

Well, just got a reply from the eBay rep and they closed the case. All good it seems, get my re... they closed it in HIS favor, even though he readily admitted he sold phake stuff to me and passed it off as real. I buy 5+ things and day and have 100s of buyer feedback, and they ruled in favor of someone with 70 something feedback, crazy.

What should I do now? This account is my own info and it's real.

A few options:

Either do a chargeback on your CC through paypal

OR

Call ebay and paypal and explain your case that even the seller admitted.


Please note that they may limit/restrict your privileges with the Chargeback option.

I can't afford to have my buyer privileges restricted, so I think I cannot do that. I will probably message them again because the person who reviewed the case didn't read anything. They said "We're sorry the item you received wasn't new".... it wasn't anything to do with being new, it was that it was phake.

I'm trying to message them again now, but they don't even read anything, so not sure what the point is.

Try calling buyer protection or email trust and safety.

I have emailed them, so I will see what they say. If they actually bother to read it, then I should be okay, but the previous rep didn't read anything and just thought fvck it I will close the case.

Sadly happens a lot.

But at least you can claim from post office if it wasn't signed for.

Do you know how much I can claim up to? First class recorded is £50?

Edit: Yeah, around that, but need to wait 15 working days.

Hi. I think your not being refunded due to your item going missing. What was your item worth and what service did you use?

Unfortunately the wrath of the eBay robots.

1 - You will rarely lose you priviledges as a buyer these days, buyers can get anyway wit massive fraud and still be able to buy. Dont worry about this, especially for this sort of case.

2 - This happened to me before,seller admitted phake goods in emails, wouldnt reimburse return postages costs, decided in his favour. I called and spoke to someone and they reimbursed me,however they didnt cover the return postage costs.

3 - Put in a claim with Royal Mail as well as it was not signed for. You might even get a double refund from eBay and RM if you play your cards right.

what is the deal with the tracking? recorded often is not updated online but still gets delivered. What was approx price of item?

15 working days is better than getting no money back.

Next time open a not as described return.

The seller is automatically liable for return costs.

You just need to print off the return lable ebay provide.

How did you pay for the item as you can claw back your money and buyers can get away with murder and still be buying.

There is also some other rule about posting ⊗⊗⊗⊗ being illegal that I have seen used in a scam against sellers so you may have other options.

You should call Paypal who won't be happy if the seller is selling counterfeit goods. Their Branding Protection team could well limit the sellers paypal account which is enough to disrupt his sales.

If you don't want to go that route , get a friend to buy the same item or another equally bootleg item then do the complaints process differently.
Ebay should have a specific section where you can report counterfeit items.

There is a Report Item on each listing ( or there used to be).
Persist with both ebay and paypal. Its rare for sellers to win claims specially if the item really is ⊗⊗⊗⊗

Not really.

I recently had a buyer open an INR case. I had sent the item standard Royal Mail without tracking / signed for. Before I had a chance to respond the case (was going to refund it), the buyer immediately escalated it. By the time I logged into the account the case had been closed in my favour, lol.

I love ebay. :thumb:
