eBay Suspension; abusive buyer policy
 
Hi guys,

I've had an ebay account for years since 2014, not that old. I had a workplace discount which involved creating a new account to use the promo-code of 10% off - which is limited to 4 per account.

I created a new account to purchase an iPhone 15 Pro, the seller is one of those large refurbishers - they didn't send me an iPhone but a heavy weighted metal socket within the iPhone box. I opened a return request and the seller ignored it yesterday, I have rang the police to open a crime reference number and asked Vodafone to block the IMEI number printed from the box.

Today I tried to purchase from a different retailer and 15 minutes later I get an abusive buyer policy permanent restriction for returning too many items - I phoned up ebay and told them what's happened and why I opened a new account to use the promo and the rep filled in an appeal and saw my main account is in good standing and haven't abused the returns policy on there and sent an appeal.

My return request is still open on the 0 star account - how likely will eBay step in with the return request if the seller ignores it? I'm starting to think a chargeback through my back which is a lenghty process is the only way I'll get my money back now? I am really p**** as it is a lot of money and I'm left off scammed.

Any advice?

you wait until the ebay complaint is closed , if they do not refund do chargeback

and pray that you were smart enough not to use your main account for such purchases

advice for the future: ebay do not check details of buyers so that you could easily open buyer accounts in any names you like and there is no need to use your real details and especially an established account in your name

I can fully understand your username haha

I haven't used my main for this purposes as it is mainly for selling but now understanding the lengths of what eBay do to genuine people - I will definitely be using the stealth guide as well.

Is this seller new or old with feedback,are you sure it was not tempered with during transit?

Yes, I attached images to the return - seller did not provide label and reported me as abusive buyer.

It is a old top-rated seller, large business as well with 200k items sold. I phoned them instantly when this happened and they told me to create a return request and that's it.

Ebay have rejected my appeal today and have also suspended all my accounts including my main since 2014.

I am pissed as it took a lot of time to build the reputation and it is tarnished because of some scammer. They haven't replied at all still and 100% knew what they were doing to scam someone, they knew a new account with limited history is susceptible to the abusive buyer report and is probably not their first rodeo.

Guys - does an on-going return on a suspended account, allow eBay to still step in? Because at this rate I can only do a chargeback or send them to small claims court. I have filled a crime report and reported the IMEI of the box to Vodafone as stolen.

You done the stupid thing by given your real ebaybold account
Both accounts are gone and eBay will side the seller only way to recover by chargeback

This has also happened to me with very large sellers, some of these accounts take the opportunity to scam the small ones, eBay will always agree with these sellers.

if you do chargeback it will have to be unauthorized , if you do not as described then you are likely to be denied a refund there as well

Righty, sounds a bit odd to do that - won't the bank not look at the tracking information and see that is has been delivered to my address with photo.

I would be filing for seller not delivering the item and eBay preventing from using MBG when told otherwise on the phone.

If it is denied, I am assuming last case resort is a small claims court summons and a report to trading standards. Maybe the media might be interested but if not UK consumer law protects the customer quite a lot for these type of things.

if you can prove someoe has the phone ,not you,the reseller would be glad to refund you.

It's what I presume so will contact the business management team and explain the situation. I have a feeling they knew what they did as they saw a new eBay account with 0 feedback and pulled the abusive buyer tactic.

I did report the IMEI to vodafone, in a few days would show up on Checkmend so would be unable to be sold or used within the UK. I also have an crime report and will be going physically to a police station as well to report the business.

Unfortunately, the first rep who told me to appeal the suspension did cover my actual eBay account - probably because it is a linked details (address/phone); this in-turn screwed me over more. But I won't be using ebay after this ordeal again.

too bad you did not use paypal , actually paypal should always be used if you are a buyer , you file non authorized against paypal and your chances to win are 99.99%

with the bank you can try not as described but your chances are limited , with non authorized you will likely win as no one will be looking at any photos and tracking , credit card companies do not care in this case but with not as described they tend to reject
