How to take UK PayPal to court, please help!
Hi have been scammed out of £650. PayPal made a wrong decision on the case.
I bought an iPhone X on eBay.co.uk and paid using my PayPal balance.
Seller turned out to be a scammer, he compromised an eBay account with high feedback and told PayPal that I collected the phone and provided text messages between 2 phone numbers that I never heard of before.
eBay provided me with emails and live chats confirming that the seller story to PayPal is ⊗⊗⊗⊗, yet PayPal closed the case in his favor.
I contacted the Obedsman service and been told that PayPal terms and conditions doesn’t offer buyer protection all time, it’s a complimentary service, so the Obedsaman can not intervene with PayPal terms and conditions.
I have contacted PayPal and asked them to provide me their UK address and the scammer address but no joy, they wouldn’t provide the seller details for data protection reason I have been told, and they said that PayPal has no UK address which I am sure it’s incorrect, they will have to have a UK address in order to operate in the UK.
Now I left with no other options than taking a legal action against PayPal and the scammer.
I have an action fraud report, shall I contact my local police station!!!
Any advice please guys!!!

You should contact PayPal and update them with the auction fraud ID number
You do get buyers protection in this case and it sounds a lot like PayPal are not following their own guidelines.
You can put in a contact information request in eBay to get their address |

| PayPal already have the action report number, but they are not interested.
Unfortunately the eBay account was compromised by that scammer, the eBay account owner has nothing to do with the scam.
The question is, can I take PayPal to court because they ignored all evidence submitted from eBay and still decided the case in the scammer favour!
PayPal keep saying that I lost the case and a decision has been made and it’s final even though I have provided hard evidence from eBay to confirm that the seller is a scammer.
Does anyone know PayPal UK address as they keep referring to Luxembourg address! Can I use the Luxembourg address in court!
Any help guys will be much appreciated.

| The scammer is not registered on eBay as he compromised the eBay account.
I am sorry to start a new thread, my apologies, I just want to get some advise on how to retrieve my payment since PayPal has limited my account and not willing to help. |

I suggest opening a case on eBay, they might be able to help, as it is allowed to open a case for the same item on a different platform, if you were not satisfied with the outcome of the case. |

Been to th police station today, been told to re-contact the action Fraud department or I can take PayPal to court.
Guys, does anyone know PayPal UK address! I will be starting a small claim court against PayPal once I get their UK address.

| The one where my money is being held is a EU paypal.
My flag is US because I generally use US accounts ( all ebay acc are US).
This particular one is a UK paypal. |

That's highly doubtful, no attorney is going to help you recover $1000USD. It'll cost 4-6X that win or lose.
There's somebody on here claims they sue PP nearly every day and win every time.
It's a laughable claim, but you might try to find who it was and contact them. |

You can take them to the small claims court, shouldn't be difficult to win if there isn't even any tracking and you have ebay saying that he's a scammer.

Is it possible to include the seller who scammed me as a 2nd defendant within the same court case along with PayPal without having his UK address!
I only have his full name and his PayPal email address and the PayPal full details, I can’t get his UK address from eBay as he is not registered with them and PayPal are not willing to provide any information.
The case will be raised via Money Claim Online (MCOL) which allows to include 2 defendants.
Please let me know.

i was had the same situation but may for my bad language i don't understand well your case but if you not get your phone talk to PayPal and talk for them that u dont get any tracking number for your item for your address cuz scammer add track number in my case for other address and then case close in his favor but i contact pp and say this address not for my PayPal address and then i get my money back so do what i say may it way u can get your money from it |

I know OP is in the UK, I converted the Pounds to US $.
The bottom line is still the same wherever OP might be.
What real attorney, on either side of the pond, is going to handle a case for damages of 600 Pounds? It's ridiculous.
Any ethical attorney is going to point out it's going to cost 3-4K just to get it into court.
There's not going to be any real attorney suing on the OP's behalf.
The UK equivalent of small claims court is going to the their only option. |

Time is now over for PayPal to respond, I still haven’t received anything from the Small Claim Court and I am not sure whether PayPal has actually received the case or not.
Now, before I request a hearing date from the court, this will cost £80, shall I get in touch with PayPal! |
