Hello,

About a month ago I was selling hand sanitizer on eBay UK. It has expired and it was overpriced.
I was one of the first people to sell it on ebay in England (beginning of corona virus in the UK).

I purchased a hand sanitizer from another eBay user who sold wholesale quantities. I bought wholesale - I sold retail (about x1000 item).
The goods were expired. However, I wrote about it in the auction description.

After the first £ 6,000 PayPal temporarily blocked my account.
They asked for invoices for posting items. I sent them tracking number & invoice.
A few days later, they asked for proof of address, passport, and proof of purchase of the items which I sell. I sent them everything.

When I sold all stuff (£30,000 on the PayPal account). I received email from Paypal. They blocking my PayPal account. Photos

The reason is - "My business is too risky". They wrote that they would do a review of my account every 30 days max 180. The first month passes in 3 days.

At that time, I solved all problems with buyers. Several people asked for a refund - I accepted it. Some returned the goods - I also refunded them.

I've done everything right, I think:
- I sold the product as described (I did not lie to anyone)
- I didn't fool anyone
- Solved all return case etc.
- I sent the goods to everyone in time
- I sent all documents that PayPal asked for.

However, I am worried because it is a large amount.

1. The goods were out of date, but I described it exactly in the auction.

2. My Paypal account was registered in Poland. This is a private account. I live in the U.K and I was selling goods here on Ebay U.K. Could this be a problem? I once tried to convert this account from Polish to English. Paypal said it is not possible. They said I couldn't open a second private account in England. So the old account that I created in 2010 in Poland was left. I have used this account intensively all the time.

3. I also lost the Polish phone number in PayPal (the phone number has expired because it has not been topped up)

3. Do you think I will get the money back? If yes then when?

What would you do in my place?

Yes you will get exactly in October 2020. Move on, the account is dead, no more thing to do

Chances of getting your money back are 50 50.
When they put a hold on your account and you continued to sell up to 30k, you knew what the risks were - there's no coming back now. Just wait and see what happens.

I bought the goods earlier, later they blocked my account.
I could receive payments all the time.
The margin was high so I continued selling.
I only risked the shipping cost.
I could no longer return the goods.

They are closing your account, just need to wait out the 180 days so you can withdraw,

That account was private in Poland.
Can I open a business account in England now?

Don't you see the risk that the goods was after expired date, the phone number is inactive and paypal was Polish?

That's a lot of money.

Your mistake was not to immediately stop selling on the account when the limitation happened.

Nobody is allowed to sell Covid-19 related items now. To top it off you were selling expired goods as well which has implications itself (hence paypal saying your business is high risk to them).

I am sorry to say there is a chance of them using their "breach of AUP policy" on you and them taking all of your money.

BUT don't worry yet, and fight it. For the money involved it will even be beneficial to send a letter from a solicitor when the time comes IF they don't release your funds.

I know, that now I can't sell Covid-19 related item.

But do you know, when they banned this sale?

Also, I can't found any information about this banned.
A lot of people still sell it on eBay.

A lot of people might still sell it but doesn't make it right - ebay can always take down the listings after and ban account/suspend account

It wasnt banned it was restricted to approved sellers.

New sellers are not getting approval

Selling anything OOD is asking for trouble even if you put it in the description.

Interestingly, none of my hand sanitiser has BBD's or Use By's on them. Four different recognised brands from UK sources. I don't sell it on the bay though!

Indeed, ebay introduced restrictions on March 23.
I sold before they introduced these restrictions.
Paypal doesn't see him introduce such restrictions.
So I think my money is safe after 180 days.
Do you think so too?

Impossible for us to speculate on that. You will have to wait it out.

I am sending a claim to PayPal citing:

- Financial Ombudsman Service
- The Bank Of England
- Consumer Association UK

One question.
Account opened in Poland. However, I have lived in the UK for 6 years and I was selling here. So, am I subject to Polish law? Should I write an e-mail in Polish?

I prefer English because here are better institutions that will help me recover money faster. :uk:

I have sent an email to paypal on a dozen e-mail addresses.
I give them a few days to respond.
If they don't answer, I go on and report the matter.
I will let you know about the result.

You should get your hard earned money after 180 days,unless your buyers all file INAD in droves

The fluid was 100% original and unmodified.
About 60 days passed.
And I'm trying to get the money back now.
I wrote to them that they could leave 10% to cover returns if they were.
Sorry for my english, but this language is my 2nd...

I waiting for answer from Financial Ombudsman about 1,5 months and they sent me this e-mail. :mad:
