Scam Buyer And Action Fraud ?
 
Its all do me me and the moment guys....lol


I sold an expensive item on ebay a few months ago.

About two months later the buyer opened a case against me on ebay saying they they had not received it, so i sent them a scanned copy of the postage receipt that showed the address, tracking number and a signature.

Ebay investigated it and closed the claim in my favour and when i spoke to them on the phone they said that it looks like im not the only one they did this to and that they are keeping an eye on his account (if they know then they should close his account not watch him carry on doing it to others).

I thought that was the end of the matter but a couple of weeks later i recived an email from paypal this time saying that he has now filed a claim against me for item not received.

So i uploaded the receipt to them and then called them to explain that he had already tried this with ebay.

A day or so later paypal closed it down in my favour.

About a week later he appealed against it but again it got closed in my favour.


I thought that must be the end of it now, but last week he opened another claim against me on paypal saying its not as described.


So i called up paypal and the person said that although this looks like a scam , she would need to ask him for additional information and that if he didn't reply within three days they would just close it down again.

Well today had been 5 days so i called up paypal again to find out what's going on, and they said that he is now saying that i sent him a box of stones.

They have told him to report it to action fraud and to send them the report.


Has anyone ever dealt with a case like this?

As my thinking is that anyone could file a actionfraud report with them to get their money back.

That guy is trying a little too hard to get something for free. What was the $$$ amount of the item?

I doubt this guy will win even if he sent them the fraud report. Too many holes in his story + his past feedback of doing this to others.

I'm actually surprised how hard he's trying.

Usually you get the odd chancers that open a claim but they give up once you prove that their trying to scam you.

I'm just hoping that he doesn't file a ⊗⊗⊗⊗ case with actionfraud just so he has something to show paypal. and as he has provided what paypal have asked, they will close it in his favour.

They only closed the not received claim, but he has now opened a not as described case (I think paypal said that they call it an empty box claim) :(

Let him file the report.

it will go against him. He has to show proof that it was indeed an empty box.

Even if they look into it, why wait months to file?

Next time you are on the phone with a rep, you record it and let it be known that you intend to file fraud on the buyer since you were told 'he has done this before'

Cover your p's and Q's
Next is probably the chargeback should he lose THIS 'claim'

Edit: They may also just pay off both sides to keep law enforcement from getting involved.

I just hope you don't get a rep that has no clue and decides in his favor. I sure hope there are notes on the account. I am amazed they are letting it go this far... Actually no I'm not....lol

This buyer is an idiot.... if you had a buyer who knew what they were doing, they would have had your money and your item already.

One of the reps has put that in her opinion the buyer is a scammer but the last rep I spoke to said that although she has put that in the notes that's it's just her opinion and can't be treated as fact :(

That's what annoyed me when I was speaking to the PayPal rep.

When she said that the buyer is now claiming that he was sent stones (or gravel I can't remember now). I said can they get him you send in pictures or some sort of proof. And the rep said that there's nothing stopping the buyer going out to his garden and finding something to put next to my packaging before taking the picture.


They also said that the buyer has given them the crime number from actionfraud but they are now waiting on the report from actionfraud that can take up to 28 days before they can make a final decision.

My worry is that he could lie to actionfraud just as much as he has been to PayPal.

Let him lie.

If they have sense at the station they will question as to why he waited so long, then ask him if he told the local post about the box o rocks.

His last REAL hope now is a chargeback.

Worse comes to worse, YOU go and file a crime number against the buyer for fraud and then send that to ebay so they will be forced to side with you yet again and leave the buyer holding his gravel.

One question: Did the buyer leave positive feedback?
You may want to throw that into the reps face if he did.

Paypal did say to me that if he tries with a chargeback they will cover me with their seller protection but that was when he filed the item not received , i don't think it covers claims that say its not as described.


I actually did think about reporting him as a scammer but I'm not sure if actionfraud listens to sellers.
I'm also not sure if ill even have a chance to put my case across once they receive his report from actionfraud.


I'm hoping that they don't receive his report from actionfraud and immediately close it down in his favour as he has provided them with what they have asked without even giving me the chance to say that ill defend it.



No he didn't leave me any feedback at all.

I'd be very cautious when it comes to believing this.

If he files a charge back as "item not described" they most likely won't cover you. You must keep in mind that once the case is filed with his/her credit card company then comes the automatic bots doing their magic (removing the funds from your account)

I don't know exactly the fine print on how to get a item not described covered via a charge back but I just had one and lost it. It's not a matter of paypal "covering you" its a matter of them winning the case. Obviously its very dependent on the actual credit card company but most will cover THEIR cardholder over someone like you who is faceless...

Just saying..

And if you do have an actual MANAGER saying your covered then get their direct line or ext. #.
