Trademark - Copyright confusion
 

I had an item removed by a sporting team claiming that my item infringed on their trademark. The team name, logos, badges and nickname were all copyrighted and trademarked etc.

The item was made by myself, it's a slogan relating to the team, but doesn't actually mention any of the above on the item.

I use the team name in the description for obvious search engine purposes so is there anyway I can sell this item?

Looking at tabberone's site a few years ago was fairly similar to what I do at present. How could tabberone sell NFL themed helmets with logos and crests? There was a famous case where a trader who sold unnofficial merchandise outside Arsenal football club lost his case, but that was obvious as his items contained the club crest.

So what is the argument?

Point Blank... You are not Allowed/Authorized to sell those. Contact the VERO Owners and they will say the same.

If you want to sell your own Self-Made items then Take Out the TEAM's NAME and you should be somewhat safer.

Better bet is to find something else to sell.

Taking out the team name? There are hundreds of T shirt sellers selling their own item relating to a team and are perfectly legal. Someone writes a book about about the Washington Redskins...that's legal too. How can tabberone sell their own fabrics with American football teams on it?
