I only posted one how can they knock me out for posting one
I got a e-mail and telling me too stop or auction will be taken
I have stop if p90x is reading
I did not know it was a bootleg I bought it on cregslist

Who was the email from? Was it from a attorney called Johnson and Pham? If so they represent Product Partners who owns Beachbody and they are sending letters to everybody they can find selling the P90X threating to sue. If you receive a letter from them I would stop selling them right away.

I got a letter today also from Johnson & Pham, telling me to c &d and I have to send them $800+. Ebay took down my auction a few days ago. I originally bought the p90x off of ebay. If its counterfit, its news to me. If everyone has ignored them, do they ever hear from them again? Has anyone ever been sued?

Default johnson pham p90X!!!!

I just got a letter in the mail saying that i am being sued for trademark and copyright infringement for P90X products from a law firm in ca called johnson and pham.
They claim that I violated federal and state laws by trying to sell my copy of p90 on ebay!

they want me to pay them fines $893. What I am supposed to do? I looked at their website and lawyers and it all seems legit. Also, they have cited to other cases they have sued on.

"In the event a lawsuit is filed against you, and you fail to respond as required by the Federal Rules of Civil Procedure, we will seek a default judgment against you based upon your infringing conduct. This firm has successfully obtained multiple judgments against individuals in excess of $150,000.00 relating to the sale of counterfeit Product Partners merchandise. See Product Partners, LLC v. Aaron Watts, CV09-05958 GAF (CTx), and Product Partners, LLC v. Sondra Howard
, CV09-05965 AHM (PJWx)."

AND they attached this paper with 15 lawsuits they have filed for the same thing.

What should I do? Can I ignore them? Should i pay them? I don't have any money to get sued or to get a lawyer. The judgments they got were over like 100K!!!!

I dont understand how Beachbody can sue you for $100,000.Im thinking to get nailed that bad you would have to get raided and have 1000+ counterfeit dvd boxsets and piles of money laying around.If you sell one counterfeit dvd set to the P90x attorney that's all the proof they have.1 boxset.Even if they checked how many sales you had and your bank accounts they still have no proof....I just cant see a judge awarding Beachbody $100,000 for one counterfeit DVD set.

Calm Down,

Unless you get served by a sheriff deputy or an actual process server you are not being sued "officially".
I got the same letter a few months ago and they didn't do anything further.
Why would they? The cost alone of suing everyone who has sold these would be more than they could possibly recover because they have to sue you where you live. They are not going to travel all over the country just to sue for a few hundred here and there.

It is just a scare tactic to get you to stop selling them.
Whatever you do, DO NOT send them anything. No money, No products, No letter explaining yourself, NOTHING.
If you do, you are admitting guilt. That puts the ball back in their court.
Just take it as a lesson learned and move on.

BTW: I'm not a lawyer and I don't play one on t.v. but I do know how the legal process works as I have successfully defended myself in lawsuits without an attorney.
Every lawsuit has to follow due process and just sending someone a letter is not due process.

well ya you are right,but the question is are they going to get subpoenas for the thousands of people doing this? most likely not,itd cost them too much money to do all this stuff for everyone.yes they do it to people who are pushing big time and get many many complaints but most people doing few of these workout dvds here and there i dont think theyd do all this

2.) Money that's going into your bank. Someone else is putting money in your account, and you have no idea what it is for.
3.) The packages that being sent to your house. Make sure the wrong name is on the package, and tell them they don't live there and you don't have a clue who it is.

If it is coming by DHL you can leave a note on the door with the tracking number saying they are authorized to leave the package in a designated place and you have to sign it at the bottom. DHL considers that a signature because they keep the note. You never have face to face contact with them.
