| slapped | 08-19-2010 09:37 AM | ,,,,,And the Johnson & Pham Body count Rises,,,,
Wait and see if the take you to Court,,,,Most likely they will NOT,,, In the Meantime DO NOT AWNSER ANY of their Requests,,, |
And read through the thread alex - when you have numerous Executive members saying not to respond, saying they have knowledge on this, saying to PM them - better accept it at face value. A lot of respect =)
Oh and I am guessing the letter is to your real info? Time to start stealth =)
And if you can't deal with this heat from selling p90x (HIGHLY regulated item), stay low and stay out of the fire ha =) Seriously though, read the posts
I know I am typing arrogantly but you gotta love this line - "please help me" - learn about the law and how to avoid it $ |
| jwvanost | 08-19-2010 08:24 PM | I think its kind of odd. I just got this letter from them as well, and I have never sold any type of beachbody product and I don't even know what p90x is.
And i'm following the advice and not responding, but I'm curious why I would get this if I didn't sell their stuff.
Kind of PISSESS me off that Ebay would give them my info but I have bought the book and this will not be happening again. |

| slapped | 08-19-2010 08:34 PM | They represent Beachbody P90x. Chalean Extreme, Insanity, Instyler By Tre Milano, Levys, and a Whole lot more any of these Ring a Bell? |
| jwvanost | 08-19-2010 10:59 PM | No it actually stated that they were writing me for selling P90x. I just threw it in the delete box, I can't be bothered by there shinanigans! |
| mememe1972 | 08-19-2010 11:47 PM | they rep Your baby can read as well do not answer anything |

The only thing I can think of is that J&P requested information on someone else selling the P90X and somehow they gave out your information by mistake.
But an email is not an indication that you will be sued by J&P. The only cases I have actually seen them file is when they had an undercover person actually PURCHASE a set from a seller that turns out to be counterfeit.
Since you did not sell the P90X, or any other Beachbody products, then you have nothing to worry about. |

Read this carefully. Dont worry. Ignore the email. Ignore the email. Dont worry.:peace: |
| topseller | 08-22-2010 01:18 PM | LOL I think we have some Johsnon & Phram trolls on this board.
Feds do not get involved unless you move over 5K in product.
Anything less and they will have to bring a civil case against you at their cost.
It usually will cost them 10-15K to litigate in the hopes of winning and then they will only have a civil judgment that they really have no hope of collecting on.
Best advice is to ignore it and don't sell the product again. Or if you do make sure you are totally stealth.
If you are totally paranoid. Make sure you have a joint checking account in the unlikely or off chance situation you are worried about seizure. Also make sure your property is homesteaded. |

The Last time I got one of their Letters asking me for $15,000, I Laughed and threw it out,,,,Almost 1 Year ago,,,
In order for them to Take you to Court They must be able to prove that you sold A Lot of them,, so Do not worry,,,, |
| alex786 | 09-06-2010 10:36 PM | p90x thanks for reply brother you also received certified mail my 10 days already pass i didnt do any thing |

| Burning | 09-08-2010 11:13 PM | I don't really understand why people get scared over a cease and desist letter. It's been used in the legal system as a tactic to scare the sh*t out of people. It won't hold up in the court of law if they were to sue you, as they DO NOT have proof that you were selling "counterfeit goods," unless they were to purchase from you.
I highly doubt they bought items from you, there are HUNDREDS of listings on ebay and it would be impossible for them to check each and every item. If they don't have solid evidence that you were selling foofoo items, then I would hold that threat with a grain of salt. |
| jeffweico | 09-09-2010 12:17 AM | Burning is correct. However, be aware that undercover buyers ARE out there. While most people will never end up having an undercover buyer purchase from them it CAN and DOES happen.
Selling counterfeit goods can be dangerous. Especially to newbies who stumble upon DHgate and think it is easy money. |
