Listing being removed

I recently listed an item and after a bunch of people already bid, I got a MC999 message stating that my listing was removed because Micro**** said it violated copyright. The item I was selling was a GENUINE Windows 7 OEM disk, which according to Ebay policy]http://pages.ebay.com/help/policies/software.html you are ALLOWED to sell as long as you include the pc, motherboard, or hard drive along with the OEM software. In my listing I stated in the description that I was including the hard drive, and I also included pictures of the drive. Also there are TONS of other listings on Ebay that are the EXACT same item I was trying to sell (They also stated they were including computer hardware to comply with Ebay policy), and they were not removed. My question is why did Micro**** have my listing removed even though I complied with Ebay policy?

I'm not clear on how it s possible if it came from micro$oft? unless competitor can point and give direction to the guy that does vero for micro$ft??

You probably used a stock photo. Some items just dont play well with eBay even when you are selling the real thing. Plenty of scammerz have messed it up for honest sellers, so eBay would rather take down every listing they can rather than risk you being another scammer

GTB 11-15-2011 03:52 AM

yeah a competitor can quite easily cause you problems even though you are genuine

but, having said that microsoft maybe just dont want you undercutting them

asif they aint got enough cash

its speculation i'm afraid

dont think you will ever know the answer

just keep an eye on the sellers who sell the same

Artann 11-16-2011 02:00 PM

yeah i bet it was stock photo:doh:

GTB 11-16-2011 02:13 PM

that could well be the answer

always use your own photos when possible

also Microsoft is high vero, always gonna encounter problems

whether innocent or not

Its ridiculous. The same happened to me twice with a non stock photo. And there many others out there selling the exact same thing (original windows xp)with no problems...Ebay message says it is from an authorized MS agent
that says it violates rules.I think its B.S.,but Ebay has always been full of that also.:mad2:

Have you been exploring different options on list?

They should give u that authorized M$ email address. What's the email?

1. You used a stock photo for micro which is not good.
2. If you used a stock photo take 2 clear pictures of the certificate of authenticity and the front of the box and upload to the listing.
3. If you did not use a stock photo then its probably just a normal takedown which happens.
4. Microsuck looked at your feedback and if your were selling many they think your a scamer.
5. Look at other listings and try to see what the problem is.
6. What helps alot if clear photos and alot of description as much as you can put nomatter if other sellers don't got alot of information.
7. Hate to tell you, but microsuck is a big vero and just play smart if you have a legit item.

You can always email them with their vero email address, but they will ask for pictures and probably a receipt. Happened to me once a long time ago, but with adobe.

ALL the photos I took myself. They said to contact softwareprotection@mm-microsoft.com for any questions. This is the only item I was selling at the time.

Aviator_2010 11-21-2011 09:57 PM

I sent an email to the address it said in the message and I got a reply that said the following:

Hello,

?

Thank you for your e-mail.? Each day our team reviews hundreds of auctions and online advertisements to identify offers involving counterfeit or otherwise unauthorized software.? Our program is primarily intended to protect internet buyers from acquiring software that they would not be licensed or otherwise authorized to use.? We carefully review the listings before we request that they be removed, nevertheless, we know that mistakes are made in a small number of cases.?

?

I believe your auctions were reported to eBay due to concerns that they were offering to distribute restore, recovery, or configuration discs containing Microsoft software without also including the complete computer system with which they were originally distributed.? Restore discs containing Microsoft software are licensed "For Distribution With A New PC Only."? They are licensed under specific distribution agreements with the PC manufacturer, such as Dell, and under the terms of this license they are only to be redistributed as part of a transfer of the computer with which they were obtained.

?

It's important to remember the next time you receive recovery media to be sure to keep it with the original computer.? This will ensure that you have the recovery software available in case you need to reinstall the software, and will also enable you to transfer the software with the computer to a new user in the future.? If you received recovery software without a computer system, then you should contact the original vendor to request a refund, since the original transaction would not have been authorized.?

?

I hope this information has been helpful.? If you have any further questions or concerns, please feel free to contact us and we will do our best to assist you.

?

Thank you,

?

Beth

Were u selling an upgrade version... or something in that sense?

Aviator_2010 11-22-2011 01:50 PM

It was an OEM version, Tons of which many others of that exact same version I was selling have been on there for thirty days or more. So possibly they wanted to remove any competition like someone said earlier. Also ALL the photos I used were taken myself, so there was no copyright infringement there.

BiN4RY 11-22-2011 02:57 PM

As long as you offer some kind of hardware with the software(working or not), Microsoft will leave you alone as long as your offered hardware are considered acceptable and word your listing correctly.
