selling TOMS shoes leaded me to suspension!

Hello everyone on the forum!
I had a brand new Stealth Ebay+Premier PayPal account fully verified.
Sold a 10-15 pairs of TOMS and than got suspended!
Restored the account with the invoices, proof of address and photo id - hoped that it will not have such a problems. But when I relisted the same item - TOMS shoes and sold 1 pair got suspended indefinitely.

QUESTION
are the TOMS shoes high risk or VERO item for Ebay?
And I also cannot understand the reason of the indefinite suspension!

Can anybody help me with that and explain me what can be the problem so I would do that in future!

Thankful 04-23-2012 09:24 AM

You have the message that eBay sent you regarding this matter?

Copy paste it here, if you do.

lightmaria 04-23-2012 09:27 AM

I don't think TOM shoes are vero'd actually. prolly got suspended cause you sold too much too fast. Or a spike in sales

Yeah. copy and paste ebay's message.

unkown5454 04-23-2012 09:49 AM

Yes, they are V e R O people. Please do your research. This brand is heavily co.un.ter.feited.

You deserved your suspension. Move to selling legal products.

NoneOther 04-23-2012 09:53 AM

@lightmaria

Why wouldn't they be subject to ve ro?

They are branded and the rights owner can request their removal if they are being sold without proper authorisation i.e. you are not an approved distributor or reseller or they suspect them to be ⊗⊗⊗⊗.

Ve ro applies to any product carrying a registered brand name or logo.

Goods that are not subject to the ve ro programme are only those that are completely generic or unbranded products which in reality is next to nothing.

MC008 eBay Indefinite Selling Restriction -
Dear member

In order to maintain a safe and stable trading environment on eBay, we have determined that your account will be restricted from selling indefinitely.

Our decision is based on evidence from our records. We are not comfortable with your selling practices and/or business model and we do not feel that they are conducive to a positive trading environment.

Although you cannot sell on the site, you are still able to use the account for buying activity. We recommend that you learn more about buying basics at:
Buying basics

Please remember that you can't sell using other accounts or register new accounts to sell on eBay. If you do, it could result in having your accounts further limited, restricted, or suspended.

Regards,

eBay

Thankful 04-23-2012 10:10 AM

JEYSUS CHRIST! HOW MANY SUSPENSIONS YOU DID GET? :faint:

Listing something that got taken down - is asking for a suspension - don't matter if you sold it again or listed again both will lead to the suspension.

rsot 04-23-2012 10:12 AM

The reason is because you did NOT get Vero Clearance from the "member" that took you down in the first place. When you try to relist without gaining clearance, your account will be killed.

yuri0509 04-23-2012 10:12 AM

so if I was suspended because of that item I should not sell it ever in the future???

Thankful 04-23-2012 10:13 AM

Wait hold on - was you suspended then reinstated? then suspended again? am i correct?

unkown5454 04-23-2012 10:29 AM

Woohoo, keep on selling that coun.ter.feit trash and killing your accounts!!! :argue: :boink: :mod:

ITS BOTH

Why do you keep listing the same stuff that is getting you suspended? :boink: :boink:

Their email basically told you not to relist any item/s that you had on previously . :boink:

GrannyT 04-23-2012 11:06 AM

`Toms are heavily foo-fooed and should not be touched with a barge pole unless you are an authorised re-seller. The boys in China knocked the backside out of the job and are now totally :nono:

As for relisting something after it has been taken down - what did you actually expect them to do?

:ranger:

Some products like monster cables never get taken down for me. I can list 100s and its branded but yet I'm able to list them. I had similar experiences with other branded products. I know I some people who sell TOM shoes on ebay (americans) all the time and never get hit with a vero. I'm pretty sure some items that are branded don't get taken down for vero violations like abercrombie fierce cologne, monster cables, tom shoes. Idk maybe I'm just lucky.

rsot 04-23-2012 12:18 PM

There are prob tricks for listing but what the OP did wrong was NOT getting clearance to sell the SAME item he was suspended for in the first place.

They are still subject to the ve ro programme. The fact they do not get taken down does not alter that.

Some rights owners are more vigilant or strict in how they view their products being sold on e/b whilst other are more lenient but that can at any time request e/b to take down any listing, genuine or ⊗⊗⊗⊗ if they so wish.

:nono:

Asuming that their phakes from China.

You say you can list 100s of monster cables and other branded stuff, just because you can list them it doesn't mean you won't get caught.

If a monster representative buys off you and lets say you've sold a few 100s then you will be in huge trouble and I promise you they will chase you up for that sort of amount.

You may argue saying well alot of people sell them - but how do you know a case is not being built up on them already?

Alot of people have got caught - it will end in tears - I highly suggest you don't take that route at all, we all know its a good money but in the long run it will end in trouble.

A very dangerous game to play.. i'm not trying to judge you so don't take it personal just advising....

I also listed them in the other category as the Ebay proposed automatically - could that be the reason of suspension??

NoneOther 04-23-2012 12:44 PM

It's ANOTHER reason why you were suspended.

It's a policy breach to list in another category to avoid selling restriction.

You really need to go out and find a clue, because at the moment you really don't have one. :boink:

rsot 04-23-2012 12:54 PM

Where is the proof that eb said you could sell in other category?

no where!
not I see that is my mistake and must be the main mistake I did!

NoneOther 04-23-2012 01:20 PM

You have made several MAIN mistakes not just one

AmazonStealth 04-23-2012 01:23 PM

If you are selling a brand name or using a brand name, just do some research, and you will find all the answer you need.

rsot 04-23-2012 02:07 PM

When you get a Ve Ro take down, you need to GET permission to relist.

ok but where can I get that permission?
from ebay???
I am new to most of things!

NoneOther 04-23-2012 02:25 PM

From the rights owner of the item.

in what way can I get that permission???

when got suspended sent invoice to ebay that I owe the stock and the proof of address and photo ID!
I suppose the last time suspension that was indefinite was because of the wrong category listing!

NoneOther 04-23-2012 02:38 PM

By contacting the manufactures or their appointed agents in writing and asking their permission to resell their goods. They in turn need to provide you with that permission in writing.

The reality is that they will only get you that permission if you enter into a contractual agreement to become an approved/appointed reseller or distributor which will no doubt involve you in some substantial financial outlay.

In other words the likelihood of getting it is probably pretty slim.

rsot 04-23-2012 02:41 PM

You must write to eb to get the company contact info - though usually eb includes it in your suspension e-mail.

yuri0509 04-23-2012 02:46 PM

many thanks to all of you guys!

So, according to your logic, I can also sell tons of coc.aine and her.oin and as long as I don't get caught, it's totally legal!!! Yay!

rsot 04-23-2012 03:59 PM

I'll take a hit or 2 - why not =P
