With 4 already you're not far away from the hammer and appealing will only damage your case further as you effectively will be admitting you are selling 'counterfeit' wares without the trademark owners permission.
Create your own ASIN's or look for 'unbranded' ones where there's no trademark or it's stated as 'generic'. |

The easiest for them would be to do it in the EU or UK, easily done online and then just 60 days or so in the online journal to allow for other parties to object. No objections and you get your trademark - job done. |

Basically the documentation that Amazon asks for when you go to submit an appeal. If you can't do this, there's a very high chance you will be suspended, and it'll be a permanent one if you can't give them what they ask for. |

Saw a tale on the main Amazon forums a couple of years ago. Fairly big long time seller had been plodding along with their wares listed under a brand name they'd made up just to get the ASIN's up and running. Done it myself in days gone by and before Brand Registry was a thing.
Competitor realised this and registered the brand. Took them down and they lost their account even though the ASINs pre-dated the trademark registration. |

even amazon do it from time to time to sell their own items | Look, whist I agree with you on the first point to a degree (I'm not convinced there's a 'whole bunch' of rogue sellers roaming the platform), and I've told above how they do it for older ASIN's and clearly it's not commonplace nowadays where Brand Registry is pushed hard, I have never, not once, seen any evidence of Amazon claiming ownership of a faux brand or 'generic' ASIN to remove or damage marketplace sellers. Adding their wares to an ASIN maybe, but claiming ownership and using it to remove marketplace sellers - that's not happening.
Do you really think Amazon have decided that this is the best way to sell a new line of wares? They can create a new ASIN in seconds, promote the hell out of it and put it at the top of the search for months on end. |

I don't know if they use brand registry but removing competition , that is not an issue at all , in many cases they just block the ASIN for third party sellers
I am doubtful they would create their own ASIN's by default because the existing ASIN is running well and there is no need to do additional work apart from obtaining items and removing the competition
