Default Another copyright threat

Got a message from another seller today

Hello,
You do not offer the same OUR COMPANY brand(US TM), packaging, direct replacement warranty and/or UPC code. Please remove your inventory from all OUR COMPANY branded listings IMMEDIATELY.

OUR COMPANY

The item is a generic item and the one I have listed is identical to the one in the listing. The one I have looks exactly like the one in the picture and there are no logos or Tm symbol on anything. Also, there are at least 21 other sellers selling this item.

One thing I noticed is that the seller is in China. I think it''s just a bluff and I am going to wait for Amazon to take down my listing. Am I risking my account being shutdown form Amazon for him just complaining to Amazon? Am I risking my new account not passing review? Should I contact Amazon and ask them if it's OK for me to sell on this listing?

My other concern s the seller will buy my items and leave negative feedbacks.

From the message I was about to guess they were Chinese. Sounds like their full of it.

I just searched trademark database and find nothing about this trademark number or company. Maybe I should send him the link to the trademark search

If you do enough business on Amazon this won't be the first time you get a message like this. I have got probably a good 5-10 messages like this in the last year with nothing happening to my accounts.

What you do have to watch out for is posting on a listing where there is one seller, and that sellers name is similar or the same as the manufacturer listed in the item description, but if there are several other sellers on a listing it is typically a free for all.

usually with amazon, if they suspect foul play they won't even send you an email

so if a company thinks you're selling their product unlawfully they will just contact amazon and get you shut down, not email you

This is true. Not always the case though! Depends on the product.

The seller just deleted the listing. Too bad because I was doubling my money on it. I'll keep an eye out for him creating it again under a different UPC code.

Also, got screwed on another listing. I bought a bunch of items to sell and when I went to ship them FBA I noticed the seller changed the picture and put hs logo on the item. Now I'm stuck with them and will have to create my own listing.

Because it takes forever for them to sell when creating a new listing. That's just my experience.

When it's the highest rank for that particular item and the listing is in the top 100 then yes.

I guess I would be pissed too if you were jumping on my listing as well...and making money off of me but then again I don't know Amazon that well.
