Competitor has ripped off my design, what do I do?
 
So a few months back some newbie seller popped up and started selling a rip off of my design on Amazon, I immediately messaged him to say I want it removed. What he did was change the design ever so slightly, I thought about taking it further but he was so ammeter I thought I would let it go.

However I've just had a return from a customer who has clearly got me confused with this seller, they have returned me the rip off item instead and want a refund. I've explained that I never sent the customer this item but my real concern is that people are confusing my decent product with my IP for this awful rip off. I don't want to get any more returns for his poor product or have people leave bad reviews on my listing.

How do I go about getting Amazon to remove his listings?

Do you have any legal right to enforce the listing removal? If so, Amazon should be helpful providing you genuinely have the rights to the product (ie your creation).

If you legally own the patent or trademark for this item then you can get them removed quickly.If you dont then theres a thing called fair use for your competitor.

Completely agree, if you don't a patent or trademark on that specific design....you don't have a leg to stand on.

I'm in the process of protecting the IP on the design but it's a slow process.
