Seller including their store name in a product pages title
When a seller includes their store name in a product pages title does this make it "their" brand and give them power to claim infringement or conduct nefarious claims against any other sellers offer listings?
For example if I have a listing: 30-Up labels 1.25" x 3" by CanadianLeaf
If Joe Schmoe comes along and makes an offer listing for the same "30-up labels by CanadianLeaf" on the product page could I report the seller to Seller Performance / Seller Support and feign infringement / Insert claim against them?
Many sellers do this and the ruling is unclear. Even if the product is no way different than any other 30-Up labels expect the sellers store name in the title Seller Performance or Seller Support doesn't know this. They could take the claimants word on face value. We all know how difficult it is communicating with Seller Performance or Seller Support and just the claim alone could create massive headaches / suspension.
