| HannahMay | 07-02-2018 07:00 PM | Amazon has disposed all of my inventory!! :help:When I called Amazon last month after my account has been suspended, the rep told me that it is OK to keep my inventory there as long as I pay the long term storage fee. Also, the company rep that I work (at Amazon Seller Protection) with to try to get my Amazon account reinstated says that same thing, so I just left my inventory at Amazon-- since I have over 400 items.
Then-- last week, I got an email stating that all 456 of my inventory is successfully destroyed. And when I called the Amazon seller rep-- I got the response that what the prior rep told me was wrong. And it certainly didn't help that I didn't have what she told me in writing.
I've been talking to my friends and they suggest that I should file a small claims court for misleading/ inconsistent information and for compensation. Any suggestions or insights? |

If its worth a considerable amount i'd seek legal action but Amazon likely has you by the balls here, when you create an account im pretty sure their FBA terms and conditions outline they can destroy your inventory after XYZ days and for XYZ reasons, this is especially true for counterfeit items (not saying yours is).
Also, since you have no hard proof that a prior rep gave you false information this may prove to be difficult. Was there anyway the phone call was recorded? I dont think Amazon would give phone call recording over as well unless you light a fire under their ass.
Im not a lawyer but if this inv has a considerable amount of value seek legal aid, they will know much better on what actions to take.
Never take anyone's word for it and always get it in writing (have them send you an email). Maybe you can pull up the contact case from the rep that gave you this false information and try reopening it and have the rep confirm what they said so they can self incriminate themselves?
Seller support and their phone reps are borderline retarded most of the time and always give conflicting information so I can understand the confusion they create.

Because if that's the case, they'll automatically destroy them because they won't return the products to you.
But if it's due to something else, usually they'll send you a couple of disposal emails.
So either way, this is a really tough situation, I don't know if going to court for something like this is worth your time or money. Have you spoken with someone in higher up rather than just customer support and see if they would be willing to reimburse you somehow? |

In reality they will not give you at all
Saijin given you Good advice don't think any other option for you
Unless you recorded that call then you can take them to court but again you have to mention at the start of call that you recording otherwise you will be in breach !!! |

When you signed up for FBA they have a long contract and Terms of Service(TOS) The likelihood of suing them or even getting an attorney to attempt to is very, very, very low. Pretty much the "Agreement" allows amazon to do whatever they want with your goods, especially if they deem them illegal. |

Customers have a right to request access to the recording at a later date. The length of time an organization keeps the recording will vary.

Taking Amazon to court does not make any sense unless we are talking 10k+ in damages, even then that would be like a gamble because you may win or not at all.
How much is your inventory worth? Why were you suspended and why do you think they destroyed your product? |

That's what small claims is for it's not the same as suing them in court which you effectively cant do since it's in the terms when you signed up for Amazon seller account. Small claims limits you to $5,000 or $7,500 depending on where you live but you dont need a lawyer or anything like that. Also if your inventory was worth more than that you will have to file for the max allowed in your state and agree to receiving less that what they took from you. |

Of course we try everything with Amazon, but there are times we just chalk it up as a loss. |
