Default Chinese Cheaters

Can anyone help

Chinese cheaters keep hitting me with trademarks for major companies they obviously don’t own. I appeal with official invoice 3 weeks ago and amazon doesn’t respond notice-dispute team

In the mean time I got hit again twice yesterday. My top listing which I put over 50k advertisement dollars into is now a dog page.


What can I do? I cannot file a legal counter notice because it is trademark. How do I reinstate my listings

It is major branded item located in target/Walmart . They have a separate competing ASIN that is identical

I have a listing for a major brand

The Chinese has a listing with slightly different title & same pictures

Both listings perform very well. Yet he can attack my listing & his rank is now increased

But that’s besides the point, can anyone help me reinstate my listing

I respond with emails like this:

Hello.

We are being attacked by a competitor regarding ASIN: xxx and ASIN: xxx who goes by the name "xx"

They are filing false counterfeit claims. Every time we contest these false reports, our listings are reinstated. By the time our listings are active again, they file another report and our listings are again blocked. xxx is the only seller that remains after reports like these are filed. Multiple other sellers have been removed by this false reporting.

Please pass this along to management, investigate, and remove this seller. They are trying to remove competition to be the only seller of this product. I believe this is against AMAZONS rules to file FALSE counterfeit complaints! We do NOT sell counterfeits! PLEASE PROTECT MY ABILITY TO SELL THIS PRODUCT. This is the 10th occurrence.

What I want to know is how they are filing these false reports successfully

I understand they do it from https://www.amazon.com/report/infringement

but when I attempt to do this, amazon always requests more info because they cannot identify me as the rights owner or the agent.

Are we able to create our own ASIN with a UPC, register that particular UPC, and have a valid URL/registration number to reference?

This has been an ongoing issue in Amazon.

The solution that I know of is having a brand registry.
But you'll have to own your stuff...

that's the thing. these guys are filing reports for brands they do NOT represent

they're doing it from random accounts. im going to figure this out and play the same stupid game theyre playing

Just be vigilant and keep calling Amazon... I had to deal with one of these people for 3 months then when I got my Brand registry... oho... they are screwed.

Some have internal connections that make this happen

Others use tons of seller/buyer decoy shops to report the listings

Your response looks solid, its an unfortunate situation that many have to deal with

Notice-dispute takes 2+ weeks to respond I have already lost a lot and provide proper appeal + docs each time

Would hiring an attorney to send a letter be a waste? It’s going to cost me $500 per letter is it effective or should I stick to emailing?

Why not create your own trademark under your brand, and build up a new solid asin? This the best long term solution that will keep your brand and listing strong and prevent others from jumping on. I know you want a quick and fast resolution, but with az its better to take things into your own hands than deal with them.

same thing happened to me. took 4 months to fight and reinstate my account. meanwhile the seller who attacked me is fine and has tons of fa.ke reviews.

AMZ and EB do not care about you if you are not a registered brand/Ve.Ro member. Both have treated me the same when attacked with fa.ke DM.CA claims.

Unfortunately, you cannot register a brand and trad.emarks over night. I'm still waiting on mine and it's been 5 months. Lawyers said all I can do is start sending C&D's and threaten with la.wsuits. Told them it's useless since these are all Chinese ghosts and they agreed.

I have a registered trademark and still has issues in the past.

Even when I get false infringement brand registry won’t reinstate the ASIN against copyright from random @163.com emails.

They say to contact the other party to retract their complaint. Literally clowns 🤡

If your offer been blocked and you receive perf notification and the contact of the owner is like:
Hfggfg? 123gffg@163.com

This would not be enough to make Amzon suspicious
that the owner is phake? I wonder if amzon actually checking if every complaint is made by the proper owner or they let do so at whoever?

Huh? that can't be right, if the brand is yours, there's no way those Chinese scammers can win.

At least they never won on my stuff when they tried pulling this bs.
