It has come to our attention that you are associating your listings with our "College Flags and Banners Co." branded listings, see ASIN(s):

Our flags are custom flags which include our construction/imprint methods, MFR SKU, UPC and are exclusively manufactured, distributed, and retailed on Amazon and other marketplaces by us.
This is a common mistake as some of our logo designs are similar to other USA manufactured brands, however, are different brands and may have different construction details. Your remedy is to re-assign your listing to the correct branded ASIN or end the listing(s) and create a new listing with the correct brand.
On the other hand, if these sports flag(s) are being purchased from foreign factories, the item(s) you are buying are NOT officially licensed by the league, third party licensing firms, or respective teams. Licensing agreements are required to imprint these trademarked branded logos. These foreign factories are not authorized in this manner. Your remedy is to remove your listings and destroy or return these item(s) to the foreign seller.
Please remove your listings from the ASIN's with brand "College Flags and Banners Co." If not removed within 5 business days, a listing violation and illegal policy report will be reported to Amazon.com. Subsequently, a "test buy" of the item(s) in question will be performed and findings reported to Amazon.com as they have advised. In addition, screen shot dating will be performed to monitor this listing until removal.

I had some generic product that was made in a single factory that I attached a listing to, then I got a similar email.
They have 0 branding rights, they just have a brand name. There is nothing about that product that is unique.
You can fight it, but it's a waste of time. Create your own listing with your own UPC, problem solved. |

So, the question is twofold. ONE, are you SURE that the Branding is nonsense and if so then TWO is it worth your time to fight them? The unknown is Amazon, but I am guessing they are not going to investigate it too deeply. If they send papers to Amazon with a trademark and the product under that ASIN has marks that match the trademark, I think they would just side with them.
I would just list under another ASIN or create my own. It is not worth the trouble.
I can add a sticker with my "brand name" to an HDMI cable and say that nobody can use my trademark, but I cannot stop others from selling HDMI cables. And the people I have seen doing this are just the WORST sort of people, they are greedy, obnoxious, egotistical and enormously fat. We're talking DISCOVERY CHANNEL FAT! I can just imagine what they smell like... |

So the seller will probably actually do a test buy, and if they do that you will be screwed. If it was a chinese guy, they tend to say all this stuff and never do anything. |

Maybe this is the case is usa But Amazon uk is totally useless
Basically any seller can register trademark and then create listing with its brand name and now if any other seller try to sell in that listing the first seller threat to remove and if still not removed then simply send report to amaozn And they do remove items and if you continue to list your account gone
According to amaozn policy brand name should be printed on item rather then sticker but who cares they still remove item
So it's very risky with Amazon

That's not a n00b. And more often than not, those who import unlicensed, trademark/copyright violating goods know exactly what they are selling. Just stick around this place a bit longer before getting too upset. |

If so, you should be allowed to sell them.....if you can provide them with the proper paperwork. |

I remember a popular Throwback Jersey manufacturer who had this same problem about 10 years ago. Just because they come from the same factory does not mean they are licensed products. You can rationalize your behavior all you want. Why you would risk having your competitor who is clearly the brand owner buying your items and reporting you. ESPECIALLY IF YOUR HAVE YOU REAL INFO ASSOCIATED WITH IT.
Sounds like Certified Mail letter coming in the mail to me. Seen this so many times over the past 10-12 years. |
