Default Item removed as: Trademark Violation - Unauthorized Item.

Hi guys,

Recently, one of my listing was removed as Trademark Violation - Unauthorized Item. However, there was no code stated in the title (eg MC019, MC999 etc)

This item removed was a Vero item, but item is 100% authentic, as I personally purchased them at authorized retailer with original purchase receipt.

I have then tried to contact eBay but was indicated this was done by Trust & Safety team and I can only contact them via email. I tried to email them twice but all getting the same respond as below:

Thank you for contacting eBay to appeal the removal of your Nike shoes.

The listing in question was found to be in violation of our trademark policy. In order to keep the site safe and clean, eBay regularly receives, reviews, and takes action on policy violation reports from various third parties, including government agencies, groups with expertise in the subject matter, and members of the community. When listings are found to violate policies, we remove them and notify the seller. Unfortunately, we cannot provide any additional details as to why your item was removed. However, we suggest that you take all steps necessary to ensure that your item was thoroughly and accurately described (in title and description fields) and that the item is, in fact, what you represent it is. You may want to consult an expert to verify the authenticity of your item.

We appreciate your understanding regarding this matter.

Kind regards,

Gel G.

eBay Trust & Safety

Anyone know what shall I do regarding this matter?

Thanks in advance.

Can't relist on this account - revise and perhaps consider a different stealth account but realize, you could be taken down again

So they wouldn't care if the item is authentic?

Hmm, that's a bit bad.

I would challenge it if you have proof of the authenticity and want to keep the account.

Otherwise, you could still list on the account but keep it very clean, even if it's authentic, eBay just plain don't like you selling some stuff.

Are you able to say a little more about the brand, type of item it was?

Branded items can be sold only if an account has all approvals from VeROs. Otherwise, they will die quite fast, because of VeROs, competitors, up in smoke EB reps and so on. The other way of selling veros is creating many stealths, so if one acc dies, another one instantly pops up.

Any idea how to get approvals from Veros?

Perhaps a worthy endeavour is to create a new stealth account and approach eB BEFORE listing with all your proof - yes it's a bit tedious but worth a shot...

No, they do not care.

You may have ownership of an item, with all its paperwork that proves it is real. If the Rights owner does not allow re-selling, then you have problems.

Have you thought of contacting the IP owner?

There are certain veros that don't allow their items to be sold ate EB at all. Other do allow, but require an agreement with them. So, there are two approaches:
1) write an official letter to vero before listing, and getting their approval
2) don't mess with veros, just spawn 100500 stealths and sell without them
Choose your way.

Have you tried to contact the Vero owner directly? There should be an email address you can contact them at.

Yes, I have contacted Nike Australia Brand Protection department, and they indicate they do not have any report regarding the removal my listing and they told me to ask ebay to contact them.

Obviously I don't have the ability to make ebay contact Nike regarding this matter. So kinda stuck now.

I think it would be nice to call the EB and ask what is required to list this item without being blocked. Like, to send in more photos, papers, receipts etc. Maybe they will help.

On a stealth account, worth a shot but of course Nike won't reply to you - they get so many requests and such...makes sense they would reply only to their bigtime corporate gigs

Vero is usually due to the rights owner reporting the item being sold on ebay. If the rights owner has no report of the listing then I assume you can relist as you have proof of this.
