Looking for opinions/advice, buyer opened case.
 

I am currently operating a full legitmate account of my own that is top rated plus (first time i ever got trp). And I have a buyer that opened a case against me.

I sold a super nintendo reproduction of pocky & rocky and I specifically mentioned in the item specifics that the game is a reproduction.

Fast forward a week and the buyer opens a case saying its not authentic. So I message the buyer back and forth to get them to admit that they knew it was a reproduction before they ever bought it.

My question to all the posters is can i win this? I hate calling ebay because of a hearing impairment and anxiety that i have but i have in the past called and had some cases closed in my favor and have had negs removed. But very rarely do i get a rep that speaks clear enough for me to understand, never mind the excessive background noise and heavy accents.

I asked my mother if she would help me with the call later and she said yes. So I would like to see any opinions and advice anyone is willing to give.

No, you can't win, you're going to lose.

And if you wait for the case to close without resolving it you'll lose the case, your money, and probably your game, AND you'll get a strike for not resolving the issue.

Just accept the return and refund.

Sell something else in the future or get used to it. This is going to be an ongoing problem for you with this kind of thing.

Accept the return and move on. Why bring all this stress on yourself? Lifes to short.

I've won most of my cases as a seller.

It depends if you said a reproduction as in it's like the the game or if it's a ⊗⊗⊗⊗. Even if you said reproduction there is keyword spanning and ebay is designed to let buyer's win. Even if you said "like gucci" or "gucci inspired" and in the brand name you put hand made, they will still side with buyer.

It helps to call in. If you don't like a rep's answer just tell him to leave the case and don't make a decision. Then you can call in again and try another rep. Takes a lot of time. If it's an expensive item like $500 and it's hard to sell then it might be worth the time.

If it's a cheap item and it's easy to sell then just do a return, it's not worth the time.


Also if you have a lot of these cases then buyer's are clearly confused and you need to make it more clear that it's a reproduction.

i called and the rep said that what he could do is turn it into a buyer's remorse so the buy has to pay my 20% restock fee. I was told to call back on thursday.

i also got a negative feedback removed for selling a repro as brand new. i was told that in the future i shouldn't sell it as brand new because it was misleading. But i was told that they would erase the neg and they did.

Tell us how it went after it all wraps up.

EB reps tell ten lies before breakfast, so let's see if they come through.

they have only not come through once because i waited more than 90 days to get a neg removed.

honestly just take it back and refund the buyer.

You really don't want to have your account flagged for a reproduction item.
Sometimes people see it as a repro and because of ignorance they'll think it's just another ⊗⊗⊗⊗ which can get you in trouble.

I'm surprised you called this in. Just take the lump next time and pay the buyer's 2.61 shipping to return it.

You paid what, $12 bucks for the cart? Is it really worth risking your account for that? Are times that hard?

Next rep might not be so clueless as to ebay policies and you'd basically be admitting to ebay that you're selling unauthorized copies/replicas of an item, which is grounds for immediate suspension. Why would you do this? All because you don't want to pay the $2-3 return shipping price?

So far you have been lucky but clearly stating it is a repro doesn't really protect you...and may end up killing your account

Made a call last night. Ebay rep questioned my item being ⊗⊗⊗⊗ and i explained that a reproduction is a completely different thing from a counterfeit. Explained that the buyer stated over and over that the game is a reproduction and that i had it listed as such. Ebay rep decided to give the buyer a refund, as well as me, and no dings on my account.
