EIN/LLC/ Articles of Incorporation Question

Hi there,

My situation:
I have gone through the forums and will be filing through the IRS.gov website.
I am living and will be filing in the state of CA to avoid any other roadblocks/complications of filing out of state.
After I obtain my EIN, I will wait a few months from now until I will file the articles of incorporation to see how far the account can make it.

Question:
On their website, there is a list of documents...

Would I just have to file for
1. Articles of Organization (Form LLC-1)
and
13. Name Reservations

Or which other ones from the list under LLC (#'s 1-15) would I have to file?


Also, after filing the necessary articles, is that all I have to do for the LLC to be formed?

For tax stuff I really suggest you consult with your CPA.
They'll know what to do.

Sounds good, I will contact my Tax guy sometime this week.

Quick question, would you happen to know if services such as LegalZoom, or IncFile are the ones that will file all of these Articles of Incorporation, Name Availability, etc when you go with their services?

I looked really quick at the link you provided. My state is a lot easier to file, and cheaper each year to keep it going.

It looks like you need to file #1 Articles of Incorporation and also #5 Statement of Information within the first 90 days. You do not need to file the Name reservation form unless you find a name available and want to save it for up to 60 days until you get your other paperwork finished. Use the Business Search form here https://businesssearch.sos.ca.gov/ and see if your name is close to any others. As for the names, you may be able to submit several in case your first name is not accepted. Call up the Secretary of State and ask them if you have any questions.

As for making the corporation or LLC, do not use one of those online companies. Save your money and do it yourself. Go to the library, they still exist. There are examples. Each state has a minimum needed in the articles of incorporation. You will rarely need anything extra, especially just for eBay & Paypal. If you really feel the need to spend some money, order one of the kits on Amazon or Staples with forms to fill out for your corporation.

It also looks like California has an $800 minimum tax fee each year for LLCs and corporations. OUCH!!!

Ok, so I'm not one to trust legalzoom.

I prefer to have someone whom I know do it for me or a friend's personal business tax guy .

You can get an ein without incorporating, really that's an extra expense and effort for no measurable return.

When filing for an ein for the first time does the
1) Ein have to be in your real name and address?

2)Or can the ein be in your stealth ebay name and stealth address?

3)Can paypal see the name and address you have on file?

How much is it per year for your state?

Also, is it an easy process to be operating a LLC in a different state that I'm living in?
