Then yes, that's not a good reason to escalate. Escalating a return because it came in a different condition, means nothing to ebay, because ebay can't see it, and they aren't going to do it in your favor and let you keep the item AND the money. I doubt a rep even bothered to read it. All they see is a return tracking info showing delivered, which means the buyer gets his money back.

Do free returns. With free returns, you can choose what you want to refund ( up to 50%). I'm surprised you haven't done this before, as it sounds like you deal with returns and it costs you a lot.

Tracking showing delivered to the wrong address. No tracking showing delivered. The buyer straight up saying he himself damaged the item. Trying to extort you or black mail you. Stuff like that. Buyer has to blatantly fess up. And not just sort of fess up. Has to be completely spelled out for the rep. They will NOT read between the lines.

No they don't. It's pretty hard to not become top rated. The only ones with any real extra privileges are : anchor store subscribers, eBay concierge members, and fortune 500's that have a presence on eBay.
