But stay away from the stuff sold on infomercials - particularly for anything that sells for a lot of money where the product is a collection of 10 dvd's. Those are highly counterfeited and Johnson & Pham represents most of those companies.
Johnson & Pham is VERY aggressive in hunting down people selling counterfeits of their client's products. If you list on eBay or Amazon, at some point one of their undercover buyers will make a purchase from you. When they receive the item and determine it is a counterfeit, you will receive a letter from them via US Mail or FedEx. The letter will explain that you have been caught selling counterfeits and they will demand money - usually a minimum of $1,500 - to go away. If you do not pay them, they are very likely to sue. They can sue in Federal court, so they do NOT have to file the lawsuit where you live - it will be filed in California. In order to defend yourself, you would have to hire an attorney there and maybe even show up in court to testify. If you ignore a lawsuit, the plaintiff will get a default judgment in the amount of whatever the plaintiff asks for.
It IS OK to sell as-seen-on-tv products, but you need to make sure they are genuine if you don't want problems. |
