Default Need help! Ebay seller sold me ⊗⊗⊗⊗ goods

I recently purchased Nintendo SP gameboy with 55 games.
Once i got the item to my horror i got 33 ⊗⊗⊗⊗ games, they are badly copied.
This was not mentioned in the auction.
I contact the seller and she refuses to refund me after i told her the games are ⊗⊗⊗⊗. She claims that she did not know but i told her i am making her aware of it but she still does not admit she is in the wrong.
I have opened Paypal dispute but i know paypal does not support of the item undescribed dispute.
I made £83.00 for it, i am so annoyed over the seller she just not admitting she is the wrong, and now i am told her, if she does not refund me back, i am going to the police and get a solicitors and tell Nintendo company. People like her make people like us come to stealth accounts
This account is not stealth so i am not afraid of that.
Any tips anyone?

You will get your money back. Just keep the paypal dispute open and keep checking back on it. Always replay after each message from the seller. I was sold a ⊗⊗⊗⊗ item also and I got my money plus was able to keep the item. It's going to take time.

How did you do it.
The seller refuses to refund.
So what the best method. shall i call ebay and paypal

Just file a claim thru the Ebay buyer protection program. You will get your money back

Str, why didn't you send the item back? Even if it is ⊗⊗⊗⊗, I'd be pretty pissed if I was the seller and you got your money but did not send back the product. That's a major flaw in the paypal system.

majority of the time paypal will require that buyer send the item back with tracking.

Yup just open the item not as described and send it back with the tracking #. you will get your money back.

Just stay calm. Open up the dispute explaining it was not as describe. You can open it up with eBay and PayPal. Make sure you do have one open for PayPal. They will only have the opt to .

1, Refund your money in full ask buyer to sent the item back.
2, Refund in full buyer can keep the item.
3, Refund part of the money buyer can keep the item.
4, escalate the dispute to PayPal.

There is no opt where the buyer can just denied your request. Even if the buyer says they do not accept refund in there description. Just open up a dispute "not as describe" and I will say you will win about 99% of the time. I have not lost any. So for me it's at 100% please NOTE: this is if you only buy the item tho eBay. Other wise PayPal will say buying ⊗⊗⊗⊗ items is not allow.

Thank you Str for your kind advice.
I have just opened a dispute yesterday so i would wait for the outcome.
I would take pictures of the games if i do have to send it back. I am planning to sent it back with DHL. this way it can be tracked and proof of delivery would be obtained.

Then you could have re-worded the post. no? Something along the lines of
I got sold a foofoo item. I got a refund and was told to keep the item.

We all could have said, Nice one, Stream,yes?
You're happy I'm happy then... and tis good
(Must go polish me crystal ball..mind reading not going too good,like)

police can not do anything for you,it is stupid to do it,the only way is you have to deal with them by safety way,and you need to learn more experience for the market for avoid this happend.
you need to pay more attention to making more money,not is fire with these bad person,it is not worthy.

these scammers cannot live long ,and they will shut down sooner later.

of cource,you need to file the dispute for this ,no matter what result you got.Just give them a little problem

I totally dissagree ! That is bad advice !
The best way to resolve any problem with an ebay transaction is to communicate with the seller. Before opening a dispute you should politely let the seller know your concerns and ask what the seller can do to help you. If you begin with a rude email , you can usually expect a poor response. And if the seller refuses to co-operate , then it is time for a dispute.

Idea should be to try to resolve the matter with the seller.
When that seems to be unsuccessful, dispute is the next step
Ebay is a better way to go for this dispute, imo.
Threatening police and manufacturer is throwing toys out of the pram crap.
There's a way to deal with the matter in a calm matter

The OP said the seller claimed not to be aware the items were foo-foo.{ Not unreasonable given the amount of posts here from people looking for a quick buck who select to sell such items} ebay will more than likely resolve the problem. OP wins, seller learns a lesson without losing an account..... happy happy.

I wonder what the OP said in his first email to the seller ?
Did it include threats of police , and rude ranting ? Almost guaranteed it did!

Lesson to OP .. and other ebay Buyers :
You don't really get authentic louis vuitton handbags on ebay for 50 bucks!
You don't really get Authentic Brand name clothing for 10 % of what it actually costs! You get what you pay for .. so if you try to buy something for a fraction of what it is worth .. you will have to set your expectations accordingly ! If you buy a copy .. and the price is right .. and the quality is ok , then be happy. If you really have a problem with copyright infringment and want to ensure you get 100% licensed authentic goods .. then open up your wallet and pay for it ! And your probably better off going to the mall!

Well some people like to pay for what they believe is genuine items regardless of the price. Everyone has they own opnions but i am not looking for a bargain. Actually why would some people think it's all about money. It is about rules. And seller like these are the very reason we are on this forum.
And i have picked original items for the same price...
I am sick of ignorant people who can't accept the fact they are wrong and get away all sorts
Anyway i would keep everyone on this forum informed of how i got on with the claim and would help anyone who is in the same situation unlike someone on this forum who had nothing but harsh words.
Thanks to those who help us with thier support and good luck with any problems they have in the ebay and paypal world
