help with buyer claiming Item Not As Described
 
I recently sold a iphone unlocked and jailbroken. The buyer has received it for over 3 weeks now. They are now claiming the phone came as not as described but I did send it as unlocked and jailbroken I even included pictures on my auction of the phone obviously jailbroken. I think they may have plugged it into the computer or such and upgraded it bc they are saying that it came as 4.0....They want to open up a dispute case if I do not agree to refund their item and have ebay forcefully make me refund it. The listing ended on the 21st of June. Should I just try to drag this on to Aug 5 so that it is past 45 days and they cannot claim anything? If they do dispute on ebay do I as a seller have any chances winning in my case? What should I do?

can you not inform them how to fix the problem and offer discount, as it is better to loose a few dollars than your money and a phone (who knows what they send back)

I'm trying to deal with them now. I offered to walk them through how to fix it but they say they do not want to accept the responsibilities of jailbreaking the phone.... I also offered for them to ship me the phone and I will do it for them. I also offered $50 and for them to keep the phone.

Regardless whether you sent the item out in the condition stated in the listing, eBay will more than likely side with the buyer. This is just a case of bad luck, you get buyers like this occasionally who just want to kick up a fuss.

The 45 day limit won't help. The buyer has SIX MONTHS to do a chargeback in most cases. And that PayPal cannot control.

Again, right or wrong is meaningless. Buyer will win. Get the phone back and refund. Or you will find yourself with no phone and no money.

The guy is clearly an idiot. He doesn't understand the jailbreak process and in my opinion shouldn't have one. He needs a stock phone or needs to learn the setup. One or the other, not both. He has no right asking for a refund because he's a moron. But sadly, he will win. Smartphone in this case doesn't apply to buyer.

Just get it back, refund, sell it again and hope next buyer is smarter than a coffee table...

I see...thanks for all the help guys, is there a way I can ensure that I receive the phone before I have to refund their money?

Also will eBay refund all my fees that I have paid?

Yes. Have him ship it back and tell him yo will give a full refund when it arrives. Its standard procedure.

Offer full refund to him - if he says otherwise, tell him to open a dispute with paypal - they will tell him to return for full refund. Don`t let the bidder threaten you.

Not really the same - same result - eBay will ask you for refund, which will be automatically taken from Paypal. They will also tell buyer to return for full refund in all likelihood.

You're just going to have to burn all these bridges IF they pop up. Have him send it back and offer a full refund when you get it. Go from there... No need to stress "what ifs" right now. You cant stop him from getting a refund so get it back.

Ok..I accepted the full refund. Now in paypal I have a negative balance of a few hundred ( cost to refund). If I transfer that amount to my paypal now to even out the balance will eBay or paypal go and refund the buyers money right away? If I don't transfer money in to cover the negative balance soon will they charge me any fees? Also they are charging me a fee along with the refund....why is that?

No they won't but they will mail you collection notices to collect that debt from you. How much was the amount for anyways? And how long did they take for them to refund the buyer?

So you're saying that the buyer filed with ebay to dispute the item and paypal took money? That's interesting. Buyer disputes were not working that way.

Can you upload any info. I'd like to see this. Sellers have had a modicum of protection with disputes. Wonder what's going on? :spy:

I'm pretty sure now that the buyer was not refunded. Paypal just placed my money on temporary hold. I'm just worried that if I transfer that amount of money owed to balance out my negative balance will they automatically refund the buyer right away. They also charged a fee of $11.47 for i dont know what reason , anyone like to fill me in? For those wondering it was $385 + the $11.47 fee..
