Postage due on non flat rate box with a flat rate label
I found out that a seller sent a huge box to me that had a flat rate pre-paid label on it and ofcourse the box was not a flat rate box and $73 is due on the postage, the box is the size of a dishwasher so no way in heck it's flat rate and yet the seller put a flat rate paypal printed label on it.
I emailed the seller but they never replied to my emails, I guess the next step is to open a claim, but am not sure whether to do it on paypal or ebay? also, the package is still sitting at the post office, should I go ahead and refuse it now or just have it sit unclaimed and let it go back on it's own? because the delivery confirmation and what it says it probably what is going to win or lose the case for me. right now it just says "notice left"
And should I open the case now or wait until the Delivery confirmation updates and shows it was refused or never picked up? Also, I'm not sure if the post office will let it go back on it's own?
I'm not sure if they were trying to scam the system by putting a flat rate label on such a huge box or if they just had no idea what they were doing.

Refuse it, then file a claim. However, MAKE SURE The package will be updated in the system as "Return To Sender". I would confirm this with your local post office. I've had an experience where a package was returned to me but never was updated into the system as "Return To Sender". This way you will be safe.
