im wondering with him not responding at all ebay will take that into account and grant me a refund.

Not likely. Even if he doesn't respond you are still required to send it back with delivery confirmation.

well got an email from ebay asking if the seller has replied and because he has not, i was able to escalate it today. Only time will tell
