ebay case help
 
so I purchased an ungraded jordan rookie which in the listing says its 100% authentic but has no return policy. I email the seller saying if the card is deemed to be a reprint by bgs would you refund me the purchase price. He said yes. Well got the card back yesterday and it was questionable authenticity so I opened up an ebay case. What are the chances ill win with the evidence showing that it was graded and came back as a reprint and him agreeing to refund the purchase price?

You should ALWAYS contact the seller before opening a case. There is nothing worse than a person not trying to reach out to the seller before bringing ebay into the mix. Most sellers have no problem accepting returns. And if they are unwilling to work with you THEN open a case. No matter what his return policy is, if the item in not as described you will receive your money back.

i did contact the seller but haven't heard anything back from him in 3 days.

You will win the case. Ebay will say ship it back and when it is confirmed delivered you will be refunded.

You were perfectly in your rights to open the case even if you did not contact the seller first. This is not a case of a misunderstanding or an item that got damaged during shipping. The seller is a scumbag and deserves everything coming to him. He either knowingly listed a copy as an original or he had no idea what he had. Either way he should have listed it as authentic unless he was sure of it.

3 Days is more than enough days to get back to you. If the card is not genuine then you should get your cash back.

The seller said you he would give you a refund and you probably didn't even bother to contact ,then open a case the next day .When your a seller yourself you should know not to do this.

All it takes is 3 cases to loose top rated seller status. I don't have know how futureMong888 can even say its right opening cases without contacting sellers first .

regardless, i told the seller that when it was sent out for grading that if it is deemed to be a ⊗⊗⊗⊗, that day I will open a case. I followed through and still haven't heard anything back since last week. I can almost assure you that I won't hear back from the seller ever again, it will be up to ebay to refund me.

Why do you have to open a case before contacting the buyer first??? Seriously that really bugs me!!

You will win the case but as a seller you should know that its not cool at all when someone opens up a case, im sure if you dealt with the seller directly it could have been resolved, of course if he/she then refused to give you a refund, THEN you can open a case and not before!

i told him if it was a ⊗⊗⊗⊗ to refund me, no response for 2 days so i opened a case whats wrong with that.

Seems like ebay will just say return it to the seller regardless of a return policy and get your money back

Yes ebay will probably 99% of the time say that the buyer has to return the item to the seller to get a refund.
But the last 2 times this happened to me, The buyer refused to send it back, because of the cost of postage to them, as ebay will only refund original price & packaging :p

Although if it is on a account i really care about then i offer to pay the return postage to save myself from a negative :brushteeth:

thats kinda funny, how can shipping costs be that expensive to not return an item

I deal with lots of memorabilia, but would never touch anything shady like a reprinted card, practically the same thing as counterfeiting money, and anyone dealing in that kind of business is a serious low life.

This seller should pay for your return shipping and if I were you I would rip the card in half when I mailed it back so they can't resell it.

FYI: 90% of ungraded Jordan's are ⊗⊗⊗⊗. A card as valuable as this should alway's be graded. How do I know the seller knew it was a ⊗⊗⊗⊗? Just playing the odds. If you had a card that you knew you could quadruple your money on just by sending it in for grading, why wouldn't you? Jordan graded cards are worth 10x more than ungraded, even in worse condition. They are so highly ⊗⊗⊗⊗d that the grade is crucial, even poor grades are worth more than a mint condition ungraded.

the guy hasn't responded to the ebay case at all but i have to wait til thursday to escalate it. Hopefully I win, I can care less about the return shipping as long as i do signature confirmation ill be fine.

took pics of the card when I received it and when it got graded, same card. I'm not the crook in this situation

Bear in mind a buyer might have as much knowledge as the seller.

Lots of people on ebay do sports memorabilia, lots.
