Trademark Violation
 
Ok. Opened a new account and maybe I did get carried away w/my listings but only listed 10 items...nothing too fancy-looking. Sold most of those items and this morning woke-up to this lovely header in email:

MC019 eBay Listing Removed: Trademark Violation - Unauthorized Item ( 191512226)

The rest of my listings...only 4 left...were pulled. How do you get around this? Can I email the company of the product I am selling with proof that they are real and not copies? If so, what sort-of proof do they ask for...or...is this just a dead-end? Would really like to continue selling this product. What do you think?

If you contact the company and can prove they are genuine, you will be okay to relist them. The email should state that when the items got removed.

Mants is correct, you can Mail the company, and in fact Ebay recommend that you do so, but to be honest, the representitive you Email, has to agree that the items are genuine, then contact Ebay direct themselves, stating that the items were brought down in Error, and that U have the ok to relist..

Personally if i was some head of department of a multi national.. i wouldn't entertain the hassle.. theyre under no obligation to do so..

I do plan on sending an email to the Company asking what sort-of proof do they require for me to sell-hassle free (if that is possible) on eb. Was just wondering if anyone has actually gone through w/emailing a company for permission & what they may require as proof?

Hi, TD- I have worked close with my acct rep + the Vero items...up and down for past couple yrs...If its a Franchised Item..they don't like it on ebay-they want their auth dealers to sell it..I would send a friendly email + your sales receipt from the auth dealer..tell them u recd/bought + didn't fit u + dealer wouldn't return..they may reverse the takedown...if your items not 100 percent authentic...just move on..the more waves u cause-u will be watched...

My item was a lousy inexpensive hair iron!! Here is the thing: very friendly w/owner of local hair-salon. I can get my hands on items at a very reasonable price and then of-course re-sell on eb for a let's say, fair price.

I did send a very friendly email to Company asking them what they would require for me to be permitted to sell on EB. Will see what happens but in meantime, this account is worth nada!! I can't list the rest of my stock and stuck once again w/money invested in merch. sitting on a shelf.

Yes..join the club... Have (2) Forty Foot Trailers stocked + paid for out back...Was on verge of a Nervous Breakdown b4 I joined this forum + Aspkin showed me how to sell again..And his new Stealth book is Fab! ;)

I am sure the new Stealth book is amazing & helpful but honestly, like others here...I am a single-mom who busts her butt during the day & by night tries to make a few dollars on eb. Have too much invested in stock just sitting here to do anything right now but be patient...read some more of this forum and slowly get rid of these items.

Hmm, the only thing you can do is talk to the VeRO and hope for the best. VeRO stuff is always hard to get around unless you keep at it at all times.

Have you tried other ways to sell your items TotallyDisgusted? Craigslist, Amazon, etc?

Looking into Amazon, not sure if it is for me. Keep in mind, I am no powerseller...average $500-$1000 mo. w/EB; just looking to make ends-meet.

You know what...I don't even think what I was selling is a VeRO item; can't find it on those stupid About Me Pages.

To my surprise, I did get a reply email from the Company that supposedly pulled my listing from EB. The gentleman introduced himself as the in-house attorney and politely asked if I would like to communicate through my attorney. I responded with a big fat NO and asked very nicely what the requirements are that need to be met to re-sell their items. Will see what happens.

HI: TD--Why not try to move some items here? We have a Buy/ Sell area?
--ALSO: There are Trading Assts in all areas-who can move your items for a % Commission, which would generate immediate cash..

Why am I feeling so nervous this morning? Here I am calling myself Jane Doe and communicating w/an attorney from a Co. that I would like to re-sell their products. Hope I am not in BIG trouble on this one & just feeling a bit paranoid.

I would just ignore it and not worry to much.

I got an email from WACOM, that company that makes those boards that you can write on and use with photoshop, the stuff that graphic designers use.

Anyway i sold about 5 or 6 of them on ebay in 2005 and they emailed me telling me not to sell them anymore as i am not an "authrozied dealer" or an "authorized reseller" and that should i keep selling there items they would initiate legal action.

long story short, i replied saying that i didnt know that i needed to be an authorized reseller and complied with there request.
