When you submit a counter notice, Etsy gives the other party 10 days to show evidence of a court order taken against you. If none is offered then you may reactivate your listing and continue as if nothing has happened. Etsy wouldn't add it to your tally of infringements when there's no case.
With IP infringements, you don't get that option, you're plain screwed.
Oh wow, how many warnings have you had before they shut you down? I got 2 so far and basically just took down my listings couple days after they sent them...
Legit looking accounts they send a polite shutdown email, and close all accounts linked to it.
If the account is dodgy looking, a paypal only account full of obvious trademarked junk, those they shut down with no warning. Many shut down within a few days of openning because they get so many of them... from here? lol
If pushed they may respond, with a not so polite email lol.

This is not my experience regarding this issue, my shops were not 'obvious trademarked junk' like some of the shops on E*SY selling Guc ci and so on. All were DC shops with verified UK info, 2k+ sales.
