Collecting on a bounced check from an individual, help?
 
Hey there, long story short, there is an individual who owes me around $10,000. He has been slooooowly paying me back, about $500/month, well he hasn't given me money or anything to sell (an option I gave him) for over 2 months now. He has gotten the amount owed down to about $4000 and last thing I received from him was a check for $2000 that was drawn on a long closed checking account. He has avoided seeing me face to face, he doesn't answer calls and sporadically responds to texts making promises he doesn't keep. I know his name, where he lives and all his phone numbers. He is local to me and I even go by his house and even asked his dad to help out in clearing up his debt. He didn't seem like he cared. My question is.....

Where should I go from here?

File a suit in small claims court? Turn over the check to the police?

Although I appreciate your opinions, I would appreciate anyone commenting with experience or knowledge in this issue.

If you have made multiple attempts to collect the debt and he keeps blowing you off I would just let him know that you are giving him one last chance to settle it or you will file a lawsuit against him. Problem is that if he doesn't have any money or property it would be hard to collect on a judgment but its still better than nothing.

This is why I don't front anything. I would take him to small claims courts. Make sure you have every text messages he sent you and any other evidence when you go to court. Make copy's of every thing.

Contact your local Attorney Generals office.

They will bill the check writer plus fine them.

If they refuse to pay, the Attorney General will freeze all there assets bank accounts, credit cards, and can even put a leverage on his house.

They CAN do this. They may not...


Do you have proof the money is owed to you?
