Buyer filed a claim and not willing to send item back
 
For the record this is not an ebay item. A buyer filed a claim under the guise that it was not as described, which is a lie, and they refuse to send the item back. Will I still lose the claim anyway? What has been other ppl's experience with this?

If it is a non-ebay claim, there is nothing to worry. Just tell paypal the tracking and escalate the claim. Paypal do not cover "not as described" claims for non ebay purchases. Last time I had a dispute they closed it within a second.

I didn't use tracking when I shipped the item. But it's obvious the person has the item.

Like Burning said, Escalate it to a claim. If the buyer did a not as described, it will be closed..

What if they paid with their credit card and want to report it to their credit card company? Are they able to?

You'll probably lose.

Just to update on what has happened. I went to my pp account to do what I needed to do and the case was closed. There is no mention of why it was closed, who closed it or even WHEN it was closed. I certainly never got an email confirming this. The money has not been deduced from my account. Anyone have any experience with this?

They probably would have done this first. Also, if the funds were added to their PayPal account from a bank account, or if the funds were already in the PayPal account and transferred, this won't be possible.

transactions done outside ebay almost never favor for the buyer or person on the other end. least not that ive seen. thats usually how it goes. it just goes away. paypal notifies the person on the other end that their out of luck and they dont re imburse them cause they dont have to. their only hope is to usually file a chargeback with their credit card company, which in fact many people do win, but the bank usually foots the bill and you will still keep the funds. it usually only works for people who have a good standing and history with their bank and havent had chargebacks previously for anything. also doing so they usually have to report that they didnt authorize the charge for it to work. which would require them to sign a document stating they didnt. which would be illegal. but many do it anyway, and get their money back from the bank.
