Default should I escalate the dispute?

hi.
I have opened a case because the seller was lying to me for two weeks already.
His last excuse was the he "forgot to put stamps on the package" (which off course doesn't make any sense) I have decided to open a case in pp.
it's been 3 days and he doesn't respond to the case. And in addition his eB user is "no longer registered".
So will the case automatically close it self if he doesn't respond?

As long as you purchased through ebay, you should be protected under the buyer protection policy. I think they automatically and immediately find in your favor if he was suspended. Doubt they will get the refund through his paypal or backup method, but they are supposed to refund your money through their "insurance"

If he's NARU, escalate and be done with it.
