You can get an EIN without forming a company - the IRS will give you an EIN on the spot, without checking to see if the company exists but yes I do believe you're supposed to either be in the process...

When you apply for an EIN you need to put in all of your real information with the IRS. You shouldn't use your stealth name there.

The legal business name is really the only thing besides the EIN...
