hello
i got this message from ebay and i look for any help or idea
please tell me your thoughts or your expectation for what the lawyer gonna ask
i dont wanna lose my account and i live in poor country can afford too much money

Your payouts are currently on hold because your eBay payment account is restricted. A U.S. Court has directed eBay to freeze your account. Please reach out to plaintiff’s attorney at enforcement@sherinianlaw..net for more information and to resolve the matter.

Trademark/Copyright/Patent at issue: KUNSHENGZE DESIGN PATENT - D980,990
Court Case Title: 23-cv-16109; SHENZHEN KUNSHENGZE ELEC-TRONIC COMMERCE CO., LTD., v. THE PARTNERSHIPS and UNINCORPORATED ASSOCIATIONS IDENTIFIED ON SCHEDULE “A”

eBay did not decide to freeze your account, it was ordered to do so by a judge. Please understand that eBay cannot release this freeze on your payouts until we receive instructions from the plaintiff’s attorney, or we receive a copy of a notice of dismissal or satisfaction of judgment that has been filed with the court. This matter must be resolved with plaintiff’s attorney or defended in court. Plaintiff’s attorney can be contacted at the above email address. An attorney can explain to you how to defend the lawsuit in court.

the account and balance are gone

but you can open another one and sell there , they will not be pursuing you on the restricted account further , they just want you to stop selling and seize your balance

Sell something else

It did not say suspending your seller account,it is freezing your balance .
Have you tried listing something else?
Is your MP account still good?

She has it for 16 years,it is a shame,one listing and she lost the account.
May be plead your case with Ebay

Go to Ebay seller forum and ask,many sellers there

If you want the account back they will probably offer to settle for 10k or more. It's gone forget about it.

I'd immediately stop selling all related products, wait about 1-2 days and see if there's any extra infractions from the eBay side.

Sometimes it's best to let an account cool down and use back up stealth accounts, then start using the primary account again.

they payment is on hold and i still get orders

no one will take him anywhere, ambulances (law firms) the account balance will disappear and the account will probably be blocked, that's all... it works the same as on amaz/ets etc.

medo, this seems the most appropriate status, unfortunately

You will need to get backup accounts going.

Did you identify the product(s) that caused this problem?

Whilst nothing will come of the legal action, the account is dead. No amount of 'cooling down' will recover it.

I doubt it,just for one item?
But if OP has the account for 16 years and this is her first offense,she may plead to EBAY,it never hurt to try

They treat all the accounts the same. amazon, eBay, paypal etc...even if you sell one violating item for $10. They lawyers will get a judge to close the account and take all your money. If you want the account back they will demand 10k or more as settlement.

I'm just surprised ebay is still letting you accept offers but don't ship because they will take those funds too

The account is dead, you have been identified as an associate or distributor, eBay shows Member since: Sep-27-07 in Egypt, but you say you are in Brazil.
You asked the same question in the eBay forums who told you exactly the same, your account is gone, you are still selling items and eBay will hold that money, I advise you not to ship any orders and walk away open a new stealth account.

shipping is displayed as china though so account registration country , actual residence country and item location may very well be different

the main issue here is china of course , if they start selling same items on a different account but ship them from US location the problem will likely not arise as it seems to be a chinese company removing chinese competition here
