Its not worth it. It will cost roughly 150 usd for lawsuit filing not including lawyer costs. Plus you have to be in la where they are based or san fenando..wherever they are.
Its bettter to get many together and file a class action suit.

I'm sorry to tell you, but you have absolutly no chance to win such a case, you will only waste your time & money. I think harassing the buyer would be a better method
Theres no case here.
When you sign up for your ebay account you agree to all their terms of service which include clauses that state that you agree to the way they handle disputes and cases (another is an agreement to a clause that states that incase you sue them you must do so in the state of CA).
You basically give up all your rights when you sign up with them. Unless you were talking 6 figures I wouldnt even bother thinking about it.
