May I sue eBay from Canada

eBay closed my appeal case, even I didn't receive the second item from buyer, eBay refunded to buyer.

After long conversation by phone, I decide to sue eBay to get back my money from Canada.

Is it possible to win?

Its very unlikely you would be able to win anything like that. No harm in giving it a go though if its a very expensive item

Its not worth it. It will cost roughly 150 usd for lawsuit filing not including lawyer costs. Plus you have to be in la where they are based or san fenando..wherever they are.

Its bettter to get many together and file a class action suit.

BabyFat is the seller in this case so there is no option for "chargeback" on seller part....

Personaly I would involve police and file a ice report. Its a felony across country lines for theft.

My Ebay account is in Canada. May I sue Ebay from Canada? There is a small court for the money under 4500$, not need any charge or lawyer fee.

I'm sorry to tell you, but you have absolutly no chance to win such a case, you will only waste your time & money. I think harassing the buyer would be a better method

Seems like a bigger hassle than what the item is worth. Not sure you would get anywhere either.

Theres no case here.
When you sign up for your ebay account you agree to all their terms of service which include clauses that state that you agree to the way they handle disputes and cases (another is an agreement to a clause that states that incase you sue them you must do so in the state of CA).
You basically give up all your rights when you sign up with them. Unless you were talking 6 figures I wouldnt even bother thinking about it.
