Selling eBooks?

First of all, let me say that I did use the search feature before posting my question, but all of the threads on this topic seemed to be over a year old, so I thought it might be time to revisit this subject...
I know the eBay rules about digitally delivered items, and that lots of people are getting around this by mailing out CDs/DVDs containing their digital items to their buyers (or stating they'll do so in the auctions and then just emailing the buyer a link afterward).
My question is about the eBook collections that are all over eBay. These aren't the how-to guides that people are writing themselves, but rather things like:
Stephen King Complete eBook Collection (35 Novels!!!)
Sookie Stackhouse Complete eBook Collection - True Blood
My question is, how are people getting away with selling these? They all seem to have little quotes in their auction stating they are authorized to sell the products, eBay should leave them alone, etc., but we all know they are not in fact authorized to be reselling this stuff.
Despite that, the auctions seem to be all over eBay, and lots of people seem to be doing quite well with them, making numerous sales on these items every day.
I've just now got my first eBay account up and running, and I'm looking to get the 2nd one started this weekend. This account was going to focus solely on eBooks (the kind I wrote myself), delivered on CD-ROMs, as this was a pretty profitable business for me prior to eBay giving me the boot.
I thought adding some of these other eBook auctions to this account might be a way to increase profits some while still maintaining my core business.
What's the risk here? How tolerable is eBay in letting this auctions go? Anyone have any personal experience selling these sorts of eBooks? What about copyright issues? I would think the publishers would be all over this sort of thing.
