1.Did the seller supply the item tracking/shipping information & 2.do they have signature proof of item received at your end (in other words, did you sign for the package upon receipt) ??? 3.Did the seller post the item to the EB/PP verified/confirmed address ???

1.No, not right away....he eventually supplied it after several messages via ebay- I concede that this was a MAJOR warning sign that all was NOT well.
2.Someone at my house signed for the empty package in my absence & him getting the tracking information from me via EB messaging under a pretext was his insurance of confirming that the package was sent/received by the buyer.
3.It was posted to a EB/PP verified/confirmed address.

Why could you not return the package to the address on the paypal transaction page or was this an outside ebay purchase suve?

The transaction was conducted on EB/PP & within the buyer/seller protection framework. What happened was, after I discussed & raised this with the seller (politely) via EB messaging as to why I had received an empty package & why his package lacked any seller return address, the seller requested the item tracker number (in reality, he was just getting his proof of sent/received for his EB/PP claim to be valid against me) on the pretext to check it out at his end with the local delivery office. I obliged & supplied the said information even though I still had queried him at this stage as to why he was requesting information he already had (I have to shamefully admit the penny still had not dropped at this stage). :smash:
I receive a reply from him that same evening where he actually has the gall to threaten me with police action for trying to defraud him:eek: & that he is going to report
me to EB/PP for trying to scam him! I was rather speechless & pretty vexed by this stage as it dawned upon me what had just happened.:>
I went through the EB/PP
'Item not as described' protection process thinking I was covered, outlining my case & communications to PP in detail & that the seller was now actually accusing me of fraud, yet I was the victim here.:mad2:
PP requested that I file a report to the local police station to get a crime reference number (CRN);without which they will NOT proceed with the claim. I made an appointment with the local police. It was apparent they could do little beyond issuing a CRN & doing forensics tests on the box for any matches on their databases as to the ID of the seller. I supplied PP the CRN information plus pictures of the unopened package & detailed descriptions. A few weeks later they informed me that they found in favour of the buyer.
I have since learnt this is a common trick among scammers on EB/PP & this guy had subsequently did the same thing to several other EB/PP users, though I was the first of his victims. I was highly inexperienced & unfamiliar with EB/PP back when this happened a few years ago. I was definitely BRAINWASHED by the PP rubbish (as GB states elsewhere) which lulled me into a false sense of security with the PP BUYER/SELLER protection program. I was thinking PP had covered me as I had met their criteria to meet the protection under this scheme, or so I thought at least.:noidea:

I have not put any communication details in. I just posted I received an empty box without the phone I ordered. What should I do?

I would have seriously considered opening an
'item not received', request a refund & put the onus on the seller to prove his case; as the signature on file would not have been yours; the issue with the
'item not as described' is that once you've signed for it, so far as PP/police are concerned you or the delivery driver could have tampered with the package.
