Seller Refuses Return on Damaged Camera, claims I damaged it/swapped it
 
I received a camera from a seller on Ebay, who in his listing had 'in excellent condition'...'only used once'

Received the camera, its damaged, the lens area is damaged big dent, the battery does not hold the charge and there are scratches on the camera.

The Seller is refusing a return, claiming I've damaged the camera myself and sent in pictures of a different camera and he sent the camera in mint condition and it was witnessed by a 3rd party.

The camera was clearly not as described and its damaged, I've yet to raise it a dispute what can I do?

I've paid nearly £350 for a damaged camera and the seller is calling me a liar, why on earth would I damage a camera!! Help me please guys :-)

You're entitled to a return regardless of what the seller says. Initiate the process.

The seller is refusing the return, he is saying that I've damaged the camera, which is lie and he knows it.

I find it insulting the seller claims I've damaged the camera, all he is trying to do is wiggle his way out of this.

I've never had to deal with an issue like this, because I tend to sell and only buy items for myself that I need.

How would you suggest taking this further? A honest seller would accept a return and admit he sold a damaged item, but because of the high value of money involved he is refusing.

GreenBean, I've asked the seller for a return, through the return option that was available, as seller did not accept returns.

I'm angry at the seller accusing me of damaging the camera and sending in ⊗⊗⊗⊗ pictures. He claims it was mint condition and only used once, the damage to the camera indicates otherwise.

Based on your last thread, you are the abusive one here. Shame on you. I hope the seller does not continue to be your victim and you loose these funds for being a ****ty person. This forum is about selling on ebay, not ****ing over sellers.

Answer the questions I ask now.

Did you send photos of the damage? Who witnessed them, the third party you mention?

Have you ever got upset with anyone? Best thing is to relax. Time to be “cool”

Nope, that was the 200 quid camcorder she no longer wanted because she really did not read the listing properly. Her daughter advised her she was being overcharged for the item. It old and out of date

Your right, I am uspet, I received a damaged item, now seller refuses a return, saying I damaged the item myself. Sent picture to seller of damage, seller claims pictures are ⊗⊗⊗⊗. Seller claims item sent in mint condition and seen by 3rd party.

Seller is claiming i swapped the item so he does not refund me, I have the item in the original condition it was sent and all serials match, he is talking out of his ass

I'm a seller myself and never treated a buyer like this

If they won't accept a return on eBay, start a Paypal claim or a chargeback.

I hate to recommend those steps but if you've legitimately been ripped off there are steps you can take to be made whole.

My mind is all over the place, this has really stressed me out, I've spent alot of money only to receive a damaged item and when I've shown a picture of the damage I get called a liar by the seller.

3rd party is sellers friend who seller claims saw item in mint condition.
I'm a seller myself and never told any buyer wanting a refund they are a liar or making it all up.

I recently accepted a return on an item I sold, all nicely done but this seller is being stubborn

So you buy one and cancel it, buy another and it’s allegedly damaged? Maybe try going to Best Buy and getting a new item.

I've been ripped off, you can be leery the claim if you want but everything I said is genuine and real.

I did not sell the item, I bought a damaged item, which the seller claimed was in mint condition.

If this claim is true, I am baffled that you sell on ebay with any success at all if you really dont know how to handle a simple Item not described case.

It sounds A LOT more that you are trying to pull the wool over someones eyes, again.

It's the logical response lucy - if you think about it (and since you sell on eb), you know that the buyer has heavy protection and help on eb and pp for claims....that's the route to go.

Posting on the forum shows a bit of lack of effort on your part, to tell you the truth

My stress levels went sky high when the seller called me a liar, I easily get upset over tiny things and this was one of them lol

Yes the seller, I'm never going to buy high value electricals again on Ebay, not after this fiasco, better off buying off a reputable company instead

Might be a very honest and upset one.

If you sell on ebay, why does any of this upset you? The process is braindead simple. No need for any communication unless you want it....

I think what most people find odd is that your a seller on eBay but do not know how to return an item? Or the basic eBay protections you get when buying on eBay.

First thing to look at is what is the items return policy? Is the seller a business seller or a private seller?

I got the ball rolling now, never really had to return an item where the seller was calling making up stories to not take the item back for a refund, seller is private/has no return policy - probably because he knew it was damaged in the first place and now he's making threats to take me to court lol

you will always get some sellers like this one, who make threats to scare you or take you to court and its the seller that's at fault, how hypocritical is that:lol:

sometimes things happen in shipping. Sometimes things break. Sometimes we make mistakes. The seller very well may be thinking you are scamming them. I know I would be....

From your recent threads it does sound like you are a problem buyer....

However if you hadn't opened the other thread I'm sure everyone would be siding with you here and helping rather than pouring scorn on you.

Maybe online shopping just isn't for you, I know I wouldn't be buying items online If I didn't know how I was covered in case of an issue.

Your assumptions are not doing yourself any favours.

Never heard of an item getting damaged in transit?

Did you bid for the camera or was it buy now? Did the listing have enough photos for a reasonable viewing

Do you not know the seller is thinking you are not a good buyer?

Why did you enter into a contract with the seller not being aware of your options?
This is a two way street after all.
