Default ebay dispute

ive dealt with numerous disputes over the years but this is a new one

buyer claims item is ⊗⊗⊗⊗, item was used and was most def not ⊗⊗⊗⊗

i ask for item to be returned buyer refuses

ebay closes dispute in favour of buyer who gets item and money

This always blows me away. eBay letting customers return stuff for any reason they see fit is one thing. But how they can actually allow a buyer to get stuff for free is mind boggling. How in any universe do they see keeping item and getting a refund reasonable???

It's real rough but that's way things are with eBay - hell they OWN paypal so why wouldn't they want to take all the fuggin cut they can get?

We aren't only stuck with Paypal but eBay pushes its own sites for a reason - MAKE MONEY. It has worked for them so why would they break the model? Simple economics =(

I hate it as much as everyone does but we can only work around it - or not at all...

Per section 9.9 of the PayPal User Agreement:
If you lose a Significantly Not as Described Claim because the item you sold is counterfeit, you will be required to provide a full refund to the buyer and you will not receive the item back (it may be destroyed).

The problem I see with this is WHO makes the determination that the item is counterfeit? The Buyer? PayPal? eBay?

It would be one thing if an EXPERT (or at least a representative of the company owning the rights to the item in question) makes that determination. But this does not happen. There have been several posts on this forum and elsewhere by sellers losing both their money and their REAL item this way, just because the buyer claims it is a ⊗⊗⊗⊗ and PayPal just automatically sides with them. They cannot all be liars.

The buyer SUPPOSEDLY has to "certify" that the item was destroyed. In how many cases do you suppose this REALLY HAPPENS? This is completely unfair. The end result is that the buyer ends up with FREE MERCHANDISE.

This is such a scam! eBay/PayPal want to side with the buyer in every possible case. We know that eBay wants to be known as a 'safer' marketplace. Done the right way, the item would be sent to PayPal (or preferably an independent third party) to make a determination if the item was actually ⊗⊗⊗⊗ or not (and even THAT could be abused if a scamming buyer puts a ⊗⊗⊗⊗ in place of the real thing). But to do it this way would cost eBay/PayPal money, and most likely create legal liability for them if the items were later proven to be genuine. So their answer is to simply screw the sellers again by allowing the buyers to keep the merchandise AND get a refund simply by CLAIMING it is ⊗⊗⊗⊗, whether it is true or not.

If this is not illegal, it SHOUILD BE!

shocking and undoubtedly illegal if it were to be tested in court, buyer cannot unilaterally decide, it must be decided by another independant party.

Block his accounts from bidding on your auctions stat. Obviously he is up to no good but takes way too much energy to hassle - lazily have at him ha but these fuggers exist.

i once seen a little video on you tube for this sort of thing where the seller had a little video cam set up when she was packing .

Couldn't believe it when i saw it but 6 months later i realised why she went to all that trouble when i had a dispute for an item that cost 2k

Needless to say , the guy won the dispute and sent me a knacked item back, i was down real down but it's all swings and round abouts.

2 weeks later i bought the item back ( he had the balls to sell it under the same user name )

i went stealth and paid with my c/c

Stripped the knacked thing he sent me and made £700

guess what im trying to say is god works in mysterious ways but and long as your doing the right thing it will all come true in the end .

Personally i would hang this mo fo out to dry .

Yes i did a charge back , that was my intention from the beginning, whats good for the goose and all that .

i kind of saw it as inconvince money although it should be danger money on ebay .

Google Checkout is miles better than PayPal. There are already alternatives to online payments but it is people (like those on here) who must use them. Instead of complaining PayPal is the one and only online payment processor.

Yes PayPal Dispute Resolution stinks. It is highly amateurish trying to do big things and miserably failing. If PayPal can not have an effective Dispute Resolution service they should drop the service. Items Not As Described and claims as to ⊗⊗⊗⊗ merchandise should be determined by an independent party, exclusive to all parties (PayPal, Buyer, Seller) concerned. The cost of this to be borne by Buyer and Seller. This way buyers/sellers may be more willing to work together without the involvement of PayPal for Disputed transactions in grey areas.

Let us go back to the days when buyers and sellers knew their merchandise. Knew what they were buying and selling and dealt face to face a lot more.

And those making a quick buck from eBay/PayPal, get a real job.
