question about becoming a powerseller

Hi all, been selling a few month now on my mates account i can now becoming a powerseller if i like all ive got to do is change from private to a business account but the only reason i would do that is so i can list my items at the top of the page as its not really a business. my question is if i do change to a business account will ebay/paypal be on my case
