Hi,

If the customer makes a claim he will in all likelihood win as the online tracking does not confirm the delivery. The receipt you have just proves the goods were shipped not that they were delivered.

Have you contacted the post office to ask if they can do a trace?

The item has not been delivered according to RM website, so the buyer will win any claim.

But why let it go to a claim? Refund the buyer and claim against Royal Mail for the item.

Agree with the above comment. Refund and then make a claim at PO.

I have the same sort of problem.
I sold some books to a guy is Oz. he paid by excheque through paypal and wanted the books sent in two shipments, to which I obliged.
The 2nd parcel I sent has been signed for buy the buyer, but the first one is sat in a delivery depot in Oz, awaiting instructions from the buyer, as there are import duties to be paid.
Today he has filed a dispute with Paypal a SNAD? He reckons one book was damaged, which I have only just found out (2 weeks after the books were delivered), and for missing items, which as I said are sat in a depot awaiting further instructions from him.
Where do I stand on this? I have all the relevant documentation to back me up, do you think, if escalated to a claim, PayPal would side with me or the buyer?
Should I escalate it to a claim before him?
It's left my account in a negative balance, which is not helping with my current sales.
Any help would be greatly appreciated.

Thanks for listening!

Why risk an escalation on a case that you are never going to win?

Same advice as above, refund and move on.

NoneOther 11-22-2012 01:55 PM

Ooopppss! not sure what's happened here

moggym 11-22-2012 01:56 PM

Sorry, I dont really understand, why won't I win?

steve70000 11-22-2012 01:56 PM

thanks guys...
ill just wait then claim off postoffice.
just take ages...

cheers...

It is best to refund and carry on with your business. If you contest this it could go on for weeks and damage your business.

what is the basis for escalating?

That he never collected it has no weight with p/p as far as they will be concerned it never arrived with the buyer so they will find in his favour and refund.

Strike 1 against you

SNAD?

They always side with the buyer irrespective of what proof you can provide.

Strike 2 against you

That is p/p's way

Agree with above.
I gave up trying to argue any case with PayPal a lomg time ago. You can never win. Buyer always has the upper hand.

I had this happen before with royalmail. Cause the item I am selling cost under a fiver to me I just refunded the user.

Couldn't be bothered with the royal mail claim either and just let it slide. Possibly things are the posits just posted it with out a signature, item actually is lost or the sticker actually fell off which is a big possibility as they aren't very stick and the teller barely puts any force to stick it on.

I now package the items myself and have a roll of recorded delivery sticky which I attach myself and no problems since.

you got a roll of recorded delievery sticky? lol
