Do big sellers get away with it?
 
how are the big boys selling vero thousands of pounds worth per week been doing it for years, have tens of thousands in positive feedback.

Maybe because they don't
Mention item is not genuine? Maybe their customers don't care?

I've seen sellers mention in their description that the item is not OEM or is not a official product something along those lines but
Could this not
Work against them of eBay vero team have a look?

Also I condone selling of anything vero.

Your confusing the term VERO with the term ⊗⊗⊗⊗.

Selling VERO is fine so long as the correct permissions are in order.

Selling ⊗⊗⊗⊗ is not fine.

Lots of good legal ways of selling vero. One is being the vero rights owner, second is having a dealership and having permission, third is selling on a platform/location that the vero rights owner has no jurisdiction or patents.

Best way is to have a dealership or be a rights owner.

I know we're your coming from, there are a sellers in the UK who have 10,000's of feedback and they sell 'cakes only' some accounts are 10yrs old some 2 or 3, they have all the hallmarks of stealth

And 100's of neg feedbacks that all say the same 'this comment has been removed by ebay'


Selling on the scale they do defo = better treatment from ebay/paypal

There's dudes selling me bonnet badges for years I was selling exactly the same item and I was told to not see it anymore. I think it makes a difference on how you describe a item i.e the title and description saying 100% authentice if it isn't seems to get a lot of attention from eBay. I know for a fact customers do not
Care because the item is identical cheaper. And you know there are listings out there where 90% of them
Are

Do you have an example? Does not have to be the items you are selling. Just any example so I can better understand.

Gotcha. So I know just enough info about OEM and auto parts to get myself in trouble. So pretty much as long as a certain time period goes by you CAN USE the name brand for a key word as long as you make it clear it is NOT OEM and is aftermarket.

HUGE difference between OEM, aftermarket and ⊗⊗⊗⊗.

Copyright law in the UK is a very complicated of confusing area of law.

Often you can sell things with the logo of a company in a lawful manner so long it is clear that the item is not manufactured by the company (although of course there is a lot more to it then that)

OEM= Original Equipment Manufactured. NON OEM or aftermarket is parts FOR trademarks such as BMW but not manufactured by BMW. NOT ⊗⊗⊗⊗ but made to be used on.

Not really in the auto parts world.

Tons of parts and accessories to be made for BMW as example. Seat covers, emblems, brakes, mechanical parts, etc... but not made by BMW. It makes sense that you can advertise:

High Quality Genuine Italian Leather Seat covers for Audi TT Coupe Convertible

BUT not be made by Audi AS LONG AS you make it clear it is NOT made by audi with NOT OEM or aftermarket parts in the description.

IS ILLEGAL and misleading if it is NOT made by Audi.

This is an interesting subject.

I know the UK maker of a certain specialist car part. He has VERO control on eBay as many copies began coming out of China.

eBay will always take down the small sellers of the counterfeit part, but they NEVER take down the Chinese mega sellers selling the same part.

For example only the other week he did the vero reports for six sellers, all just selling a few of this item, and the Chinese would currently stood at 678 items sold. EBay removed all the small sellers, but not the chinese mega seller (although listed as UK based). He sent the forms over no less than twenty times - and the listings are still there!

Same photo as two of the UK sellers as well and the same description.

So if you get away with it till you are making eBay big money, you may be immune!

The interesting aspect about China and China sellers shipping from China is that many if not most Trademarks and patents are NOT recorded in China. That means it is NOT illegal for many Trademarked and patented protected items for Europe and USA to be sold and shipped from China.

In my nitch little business world almost all patents and trademarks are recorded in USA and Canada Only fir example. Many don't record in Canada even.

You are talking about legality, eBay does not work with legalities especially in the UK as they are technically an offshore company. The issue i raised is more that eBay would not remove the mega seller, this mega seller was drop shipping to the UK and selling on UK ebay, that makes it a UK sale.

I am not familiar with UK but in the USA it is the case.

Also keep in mind, ebay does not handle vero themselves, it is the Vero rights owners that have ebay remove listings. NOT ebay themselves. That does not mean that is ebay feels something is fishy they are not sensitive.

I want to sell a item that is non OEM but the market is full
Of Chinese sellers which I don't mind but the
Lack of actual uk sellers worry me are they not selling becouse of fear of getting listed? But I do not think eBay would penalise a uk seller over a Chinese seller would they?

Ratio is about 100 Chinese sellers to one ul seller

Last week i bought ibeats for 25£ from a famous UK seller with more than 1 milion!! feedback.Received high copy phakes,nothing close to my girlfriend genuine ones.

When i looked in his negative feedback's,they were hundreads of customers reporting for phakes.

Ebay is taking some big cash under the table from these sellers i think.

It is not ebay that monitors VERO. It is the VERO owner rights. So if ibeats gets an attorney and has the correct papers and possibly a court order, ebay will take down those listings...

I keep on hearing big sellers getting away with it.
Small sellers get away with it to but lets be honest about it. If a seller who sells 100,000 items a month have a 1% defect rate they can sell a significantly larger amount of junk compared to a small seller. It is the same math on a grander scale.

I guess if you want to get away with it more, sell more stuff. It is easier to do it the right way though and not have the defect or ⊗⊗⊗⊗ comments in feedback, etc...
